रांची: झारखंड हाईकोर्ट ने छोटानागपुर काश्तकारी अधिनियम (सीएनटी एक्ट) की धारा 71-ए के तहत आदिवासी भूमि की बहाली (Restoration) से जुड़े मामलों में एक महत्वपूर्ण फैसला सुनाते हुए स्पष्ट किया है कि कानून में समय-सीमा का उल्लेख न होने का अर्थ यह नहीं है कि कई दशक पुराने मामलों को कभी भी दोबारा खोला जा सकता है।

न्यायमूर्ति संजय कुमार द्विवेदी की एकल पीठ ने कहा कि यदि किसी भूमि विवाद का विधिवत निपटारा हो चुका है और उस आदेश को निर्धारित समय के भीतर चुनौती नहीं दी गई है, तो वर्षों बाद उसी मामले को दोबारा उठाने की अनुमति नहीं दी जा सकती। अदालत ने कहा कि प्रत्येक कानूनी कार्रवाई “उचित समय” (Reasonable Time) के भीतर की जानी चाहिए।

क्या है मामला?

यह मामला रांची जिले के चान्हो थाना क्षेत्र स्थित खाता संख्या-41, प्लॉट संख्या-610 की लगभग 1.32 एकड़ भूमि से संबंधित है। याचिकाकर्ता अमर कुमार चौधरी के अनुसार उनके पिता ने वर्ष 1947 में यह भूमि 2,500 रुपये में खरीदी थी और तब से परिवार लगातार उस पर काबिज रहा।

वर्ष 1962 में इस भूमि को लेकर विवाद उत्पन्न हुआ, जिसके बाद टाइटल सूट दायर किया गया। वर्ष 1965 में दोनों पक्षों के बीच समझौता हो गया और न्यायालय ने उसी आधार पर मामले का निपटारा कर दिया। इसके बाद लंबे समय तक इस भूमि को लेकर कोई विवाद नहीं हुआ।

पहली बार कब दायर हुआ बहाली का मामला?

करीब दो दशक बाद वर्ष 1986-87 में इस भूमि को लेकर एसएआर (Scheduled Area Regulation) कोर्ट में बहाली का मामला दायर किया गया। सुनवाई के दौरान एसएआर अधिकारी ने सभी तथ्यों और सीएनटी एक्ट के प्रावधानों पर विचार करते हुए आदेश दिया कि मूल आदिवासी रैयत को समान क्षेत्रफल की दूसरी भूमि उपलब्ध कराई जाए।

इस आदेश का पूरी तरह पालन किया गया। वैकल्पिक भूमि की रजिस्ट्री हुई, म्यूटेशन किया गया और किसी भी पक्ष ने उस आदेश के विरुद्ध अपील नहीं की। परिणामस्वरूप वर्ष 1988 का आदेश अंतिम रूप से प्रभावी हो गया।

20 वर्ष बाद फिर शुरू हुआ विवाद

वर्ष 2006 में उसी भूमि को लेकर दोबारा एसएआर कोर्ट में बहाली का मामला दायर किया गया। एसएआर अधिकारी ने इसे पहले से तय हो चुके विवाद (Res Judicata) का मामला मानते हुए याचिका खारिज कर दी।

हालांकि बाद में अपीलीय प्राधिकारी और पुनरीक्षण प्राधिकारी ने एसएआर अधिकारी के आदेश को पलट दिया। इसके बाद याचिकाकर्ता ने झारखंड हाईकोर्ट का रुख किया।

हाईकोर्ट की महत्वपूर्ण टिप्पणियां

विस्तृत सुनवाई के बाद हाईकोर्ट ने अपीलीय और पुनरीक्षण अधिकारियों के आदेशों को रद्द कर दिया। अदालत ने कहा कि यदि कोई आदेश वर्षों पहले अंतिम रूप ले चुका है और उसे समय पर चुनौती नहीं दी गई, तो बिना किसी नए तथ्य या ठोस कानूनी आधार के उसी विवाद को दोबारा नहीं खोला जा सकता।

अदालत ने यह भी स्पष्ट किया कि केवल इसलिए कि सीएनटी एक्ट में बहाली के लिए कोई निश्चित समय-सीमा निर्धारित नहीं है, इसका अर्थ यह नहीं है कि कार्रवाई अनिश्चितकाल तक जारी रह सकती है।

सुप्रीम कोर्ट के फैसलों का भी उल्लेख

अपने निर्णय में हाईकोर्ट ने सुप्रीम कोर्ट के सीटू साहू तथा फूलचंद मुंडा मामलों में दिए गए निर्णयों का हवाला दिया। सर्वोच्च न्यायालय ने भी अपने फैसलों में कहा है कि सीएनटी एक्ट की धारा 71-ए के तहत भूमि बहाली की कार्रवाई “उचित अवधि” के भीतर ही की जानी चाहिए।

हाईकोर्ट ने कहा कि बिना किसी नए तथ्य या कानूनी आधार के दशकों पुराने मामलों को दोबारा खोलना कानून की मंशा के अनुरूप नहीं माना जा सकता।

अधिकारियों की कार्यवाही पर अदालत की टिप्पणी

अदालत ने पाया कि अपीलीय एवं पुनरीक्षण अधिकारियों ने यह मान लिया था कि विवादित भूमि पर कोई स्थायी निर्माण नहीं था, जबकि रिकॉर्ड पर उपलब्ध गवाहों के बयान इससे अलग स्थिति दर्शाते थे।

कोर्ट ने यह भी कहा कि राज्य सरकार अपने दावों के समर्थन में कोई ठोस दस्तावेज या विश्वसनीय साक्ष्य प्रस्तुत नहीं कर सकी। ऐसे में केवल अनुमान के आधार पर पहले से अंतिम हो चुके आदेश को पलटना न्यायसंगत नहीं था।

फैसले का संभावित प्रभाव

इस निर्णय का असर झारखंड में सीएनटी एक्ट से जुड़े अनेक लंबित एवं संभावित भूमि विवादों पर पड़ सकता है।

• वर्षों पहले समाप्त हो चुके विवादों को दोबारा उठाने की प्रवृत्ति पर रोक लग सकती है।
• वैध प्रक्रिया के तहत भूमि खरीदने वाले खरीदारों को अधिक कानूनी सुरक्षा मिलने की संभावना है।

कानूनी विशेषज्ञों के अनुसार यह फैसला न्यायिक आदेशों की अंतिमता (Judicial Finality) के सिद्धांत को मजबूत करता है। यदि पहले से निपटाए गए मामलों को बार-बार खोला जाएगा तो न्यायिक व्यवस्था की स्थिरता और विश्वसनीयता प्रभावित होगी।

हालांकि विशेषज्ञ यह भी मानते हैं कि यदि किसी मामले में धोखाधड़ी, फर्जीवाड़ा या नए महत्वपूर्ण साक्ष्य सामने आते हैं, तो कानून के अनुसार ऐसे मामलों पर अलग से विचार किया जा सकता है।
