गुमला : ऑनलाइन खरीद-बिक्री में गड़बड़ी को लेकर जिला उपभोक्ता फोरम ने कड़ा रुख अपनाते हुए फ्लिपकार्ट इंटरनेट और सैमसंग इंडिया पर संयुक्त रूप से जुर्माना लगाया है। फोरम ने कंपनियों को आदेश दिया है कि वे गुमला निवासी शिकायतकर्ता चंदन कुमार झा को एक महीने के भीतर 28,424 रुपए का भुगतान करें।
गुमला जिले के दुन्दुरिया, बैंक कॉलोनी निवासी चंदन कुमार झा ने फ्लिपकार्ट इंटरनेट के जरिये सैमसंग कंपनी का माइक्रोवेव ओवन 13,424 रुपए में ऑर्डर किया था। ऑनलाइन भुगतान के बाद 20 अक्तूबर 2023 को डिलीवरी और अगले दिन 21 अक्तूबर को उसका इंस्टॉलेशन किया गया।
इंस्टॉलेशन के दौरान उपभोक्ता को पता चला कि ओवन का निचला हिस्सा टूटा हुआ है, जिस कारण मशीन का बैलेंस बिगड़ गया और उसमें लगातार कंपन होने लगा। इसकी शिकायत फ्लिपकार्ट और सैमसंग से की गई, लेकिन समस्या का समाधान नहीं किया गया।
उपभोक्ता की शिकायत और फैसला
समस्या का निवारण न होने पर श्री झा ने जिला उपभोक्ता फोरम का रुख किया। पक्षकारों को नोटिस भेजने और सुनवाई करने के बाद फोरम ने पाया कि सेवा में स्पष्ट तौर पर त्रुटि है।
फोरम के अध्यक्ष ओमप्रकाश पांडेय और सदस्य सैय्यद अली हसन फातमी व सरला गंझू की बेंच ने आदेश दिया कि:

उपभोक्ता को या तो नया माइक्रोवेव उपलब्ध कराया जाए

अन्यथा पूरे मूल्य 13,424 रुपए की वापसी के साथ-साथ

10,000 रुपए जुर्माना और 5,000 रुपए वाद खर्च

कुल मिलाकर 28,424 रुपए का भुगतान एक महीने के भीतर अनिवार्य होगा।
उपभोक्ताओं के लिए सबक
फोरम के इस आदेश को ऑनलाइन शॉपिंग उपभोक्ताओं के लिए एक बड़ी राहत माना जा रहा है। यह फैसला साफ संदेश देता है कि यदि कंपनियां ग्राहकों को डैमेज प्रोडक्ट उपलब्ध कराती हैं और शिकायतों का समाधान नहीं करतीं, तो उपभोक्ता अपने अधिकार की रक्षा के लिए उपभोक्ता फोरम का सहारा ले सकते हैं।
