झारखंड कांग्रेस लीगल सेल : उपेक्षा, निष्क्रियता और संगठनात्मक शून्यता की कहानी

भारतीय राष्ट्रीय कांग्रेस का इतिहास देश के सबसे प्रतिष्ठित विधिवेत्ताओं, संवैधानिक विशेषज्ञों और वरिष्ठ अधिवक्ताओं से भरा पड़ा है। स्वतंत्रता आंदोलन से लेकर आधुनिक भारतीय लोकतंत्र तक कांग्रेस से जुड़े अनेक बड़े वकीलों ने देश की राजनीति और न्यायिक विमर्श को दिशा दी है। पार्टी में ऐसे कई नेता रहे हैं जो केंद्रीय मंत्री भी बने और जिनकी कानूनी क्षमता को राजनीतिक विरोधी भी सम्मान देते हैं। संसद से लेकर सर्वोच्च न्यायालय तक कांग्रेस की मजबूत बौद्धिक और विधिक उपस्थिति लंबे समय तक उसकी पहचान रही है। लेकिन विडंबना यह है कि राष्ट्रीय स्तर पर इतनी मजबूत कानूनी परंपरा रखने वाली कांग्रेस का लीगल सेल संगठनात्मक रूप से सबसे कमजोर इकाइयों में गिना जाता है।

अन्य आनुषंगिक संगठनों की स्थिति भी बहुत बेहतर नहीं कही जा सकती, किंतु लीगल सेल की निष्क्रियता सबसे अधिक स्पष्ट दिखाई देती है। जबकि आज की राजनीति में न्यायालय, संवैधानिक संस्थाएं और कानूनी संघर्ष राजनीतिक लड़ाई का महत्वपूर्ण हिस्सा बन चुके हैं।

झारखंड में कांग्रेस लीगल सेल की स्थिति विशेष रूप से चिंताजनक है। राज्य गठन के बाद से लेकर आज तक यह संगठन कभी भी प्रभावी और सक्रिय स्वरूप में सामने नहीं आ सका। पिछले सात वर्षों से कांग्रेस राज्य की सत्ता में सहभागी रही है। इस दौरान संगठन सृजन, सदस्यता अभियान, प्रशिक्षण कार्यक्रम और विभिन्न मोर्चों के विस्तार को लेकर कई दावे किए गए, लेकिन लीगल सेल लगातार हाशिए पर ही बना रहा।

झारखंड कांग्रेस में लीगल सेल का अस्तित्व अधिकतर कागजी ही दिखाई देता है। संगठन के अध्यक्ष वर्षों से एक ही व्यक्ति बने हुए हैं। बताया जाता है कि लगभग 28 वर्षों से नेतृत्व में कोई बड़ा परिवर्तन नहीं हुआ। इससे संगठन में नई पीढ़ी के अधिवक्ताओं को अवसर नहीं मिल पाया और न ही कोई गतिशील कार्य संस्कृति विकसित हो सकी। स्थिति यह है कि प्रदेश स्तर पर लीगल सेल की पूर्ण कार्यकारिणी तक सार्वजनिक रूप से स्पष्ट नहीं है। अधिकांश कार्यकर्ताओं और अधिवक्ताओं को यह तक जानकारी नहीं रहती कि संगठन में सक्रिय पदाधिकारी कौन-कौन हैं।

झारखंड में कांग्रेस विचारधारा से जुड़े बड़ी संख्या में अधिवक्ता मौजूद हैं। जिला अदालतों से लेकर उच्च न्यायालय तक ऐसे अनेक वकील हैं जो वैचारिक रूप से कांग्रेस के साथ खड़े दिखाई देते हैं। चुनावी मामलों, जनहित के मुद्दों और राजनीतिक विवादों में वे व्यक्तिगत स्तर पर पार्टी समर्थक भूमिका निभाते भी हैं। लेकिन इन अधिवक्ताओं के बीच संगठनात्मक समन्वय लगभग नगण्य है। कोई साझा मंच, नियमित संवाद व्यवस्था या विधिक नेटवर्क विकसित नहीं हो पाया है।

सबसे गंभीर तथ्य यह है कि झारखंड कांग्रेस लीगल सेल ने वर्षों में कोई बड़ा राज्यस्तरीय सम्मेलन, अधिवक्ता प्रशिक्षण शिविर, संवैधानिक विमर्श, विधिक संगोष्ठी अथवा संगठित आंदोलन नहीं चलाया। न जिला इकाइयों के गठन की स्पष्ट प्रक्रिया सामने आई और न ही बूथ या प्रखंड स्तर तक विधिक टीम तैयार करने की कोई गंभीर पहल हुई। जबकि दूसरी राजनीतिक पार्टियों ने कानूनी मोर्चे को संगठनात्मक रूप से काफी मजबूत किया है।

यह स्थिति ऐसे समय में और अधिक महत्वपूर्ण हो जाती है जब झारखंड की राजनीति में कानूनी और संवैधानिक विवाद लगातार बढ़े हैं। राज्य के कई बड़े राजनीतिक नेताओं पर विभिन्न न्यायालयों में मामले चल चुके हैं। सरकार से जुड़े निर्णयों, नियुक्तियों, खनन, भूमि, आरक्षण तथा संवैधानिक प्रक्रियाओं को लेकर भी बार-बार न्यायिक हस्तक्षेप देखने को मिला है। इसके बावजूद कांग्रेस का लीगल सेल इन मुद्दों पर संगठित और संस्थागत रूप से शायद ही कभी सक्रिय दिखाई देता है।

राजनीतिक दलों के लिए लीगल सेल केवल मुकदमे लड़ने का मंच नहीं होता। यह संगठन कार्यकर्ताओं को कानूनी सहायता देने, संवैधानिक मुद्दों पर पार्टी का पक्ष रखने, चुनाव संबंधी विवादों में समन्वय स्थापित करने, सरकार की नीतियों का विधिक परीक्षण करने और जनआंदोलनों को कानूनी आधार प्रदान करने का माध्यम भी होता है। लेकिन झारखंड कांग्रेस में यह इकाई लंबे समय से निष्क्रियता और उपेक्षा का शिकार बनी हुई है।

प्रदेश नेतृत्व की प्राथमिकताओं में भी लीगल सेल शायद कभी गंभीर विषय नहीं बन पाया। पार्टी के बड़े कार्यक्रमों, बैठकों और राजनीतिक अभियानों में इस संगठन की उपस्थिति बहुत कम दिखाई देती है। कई बार ऐसा प्रतीत होता है कि प्रदेश नेतृत्व और प्रभारी स्तर पर भी लीगल सेल को संगठनात्मक शक्ति के रूप में नहीं देखा जाता। यही कारण है कि वर्षों बाद भी इसकी स्पष्ट संरचना, सक्रिय कार्यक्रम और प्रभावी उपस्थिति विकसित नहीं हो सकी।

झारखंड कांग्रेस के भीतर यह प्रश्न लगातार उठता रहा है कि जब पार्टी के पास अनुभवी और योग्य अधिवक्ताओं की बड़ी संख्या उपलब्ध है, तब भी लीगल सेल संगठनात्मक रूप से इतना कमजोर क्यों है। यह केवल नेतृत्व का प्रश्न नहीं, बल्कि संगठनात्मक इच्छाशक्ति और प्राथमिकता का भी विषय है। जब तक कांग्रेस अपने विधिक संगठन को गंभीरता से नहीं लेगी, तब तक वह आधुनिक राजनीतिक संघर्ष के एक महत्वपूर्ण मोर्चे पर कमजोर बनी रहेगी।
