आनंद मोहन की रिहाई पर सुप्रीम कोर्ट सख्त, क्या ड्यूटी पर अफसर का कत्ल भी रेयरेस्ट ऑफ रेयर नहीं? बिहार सरकार से तीखे सवाल से बढ़ी हलचल, फैसला सुरक्षित

ड्यूटी पर तैनात आईएएस अधिकारी जी. कृष्णैया की हत्या को लेकर कोर्ट की सख्त टिप्पणी, पैरोल और सजा माफी की प्रक्रिया पर भी उठे सवाल

नई दिल्ली/पटना: बिहार के चर्चित पूर्व सांसद आनंद मोहन की समयपूर्व रिहाई का मामला एक बार फिर सुर्खियों में है। गुरुवार को सुप्रीम कोर्ट में हुई अहम सुनवाई के दौरान शीर्ष अदालत ने बिहार सरकार से कई तीखे सवाल पूछे और मामले में अपना फैसला सुरक्षित रख लिया। सुनवाई के दौरान अदालत ने यह भी जानना चाहा कि ड्यूटी पर तैनात एक वरिष्ठ सरकारी अधिकारी की हत्या जैसे गंभीर अपराध में दोषी व्यक्ति को समयपूर्व रिहाई देने का आधार क्या था और क्या सजा माफी बोर्ड के सामने सभी जरूरी तथ्य रखे गए थे।

‘लोकसेवक की हत्या को हल्के में नहीं लिया जा सकता’

जस्टिस दीपांकर दत्ता और जस्टिस शील नागू की पीठ ने सुनवाई के दौरान कहा कि ड्यूटी पर तैनात किसी लोकसेवक की हत्या को सामान्य अपराध की तरह नहीं देखा जा सकता। अदालत ने टिप्पणी की कि यदि ऐसे मामलों में राहत देने का संदेश जाता है तो इससे कानून-व्यवस्था और प्रशासनिक व्यवस्था पर प्रतिकूल असर पड़ सकता है। कोर्ट ने पूछा कि क्या ऐसे अपराधों को अत्यंत गंभीर श्रेणी में नहीं माना जाना चाहिए।

बिहार सरकार से मांगा पैरोल का पूरा रिकॉर्ड

सुनवाई के दौरान याचिकाकर्ता की ओर से वरिष्ठ अधिवक्ता सिद्धार्थ लूथरा ने दलील दी कि बिहार सरकार ने आनंद मोहन की पैरोल और अन्य महत्वपूर्ण तथ्यों की पूरी जानकारी अदालत और सजा माफी बोर्ड के समक्ष नहीं रखी। उन्होंने कहा कि उपलब्ध रिकॉर्ड के अनुसार आनंद मोहन को कई बार पैरोल दी गई थी, लेकिन इन तथ्यों पर पर्याप्त विचार नहीं किया गया।

इस पर सुप्रीम कोर्ट ने बिहार सरकार से पूछा कि क्या सजा माफी बोर्ड के समक्ष आनंद मोहन के खिलाफ लंबित मामलों, पैरोल और जेल रिकॉर्ड की पूरी जानकारी रखी गई थी। अदालत ने राज्य सरकार को पैरोल से जुड़े सभी दस्तावेज और तिथियां उपलब्ध कराने का निर्देश दिया।

2023 में नियम बदलने के बाद हुई थी रिहाई

बिहार सरकार ने वर्ष 2023 में जेल मैनुअल के नियमों में संशोधन किया था। इसी संशोधन के बाद आनंद मोहन को समयपूर्व रिहा किया गया। इस फैसले को दिवंगत आईएएस अधिकारी जी. कृष्णैया की पत्नी उमा कृष्णैया ने सुप्रीम कोर्ट में चुनौती दी थी। उनका कहना है कि नियमों में बदलाव विशेष रूप से आनंद मोहन को लाभ पहुंचाने के उद्देश्य से किया गया।

क्या है पूरा मामला?

यह मामला वर्ष 1994 का है। मुजफ्फरपुर में गैंगस्टर छोटन शुक्ला की शवयात्रा के दौरान तत्कालीन गोपालगंज के जिलाधिकारी जी. कृष्णैया की भीड़ ने पीट-पीटकर हत्या कर दी थी। इस मामले में आनंद मोहन पर भीड़ को उकसाने का आरोप लगा था। ट्रायल कोर्ट ने उन्हें फांसी की सजा सुनाई थी, जिसे बाद में पटना हाई कोर्ट ने उम्रकैद में बदल दिया। वर्ष 2012 में सुप्रीम कोर्ट ने भी उम्रकैद की सजा को बरकरार रखा था।

अब किस पर टिकी हैं निगाहें?

सुनवाई पूरी होने के बाद सुप्रीम कोर्ट ने अपना फैसला सुरक्षित रख लिया है। अब सभी की नजरें इस बात पर हैं कि शीर्ष अदालत बिहार सरकार के 2023 के फैसले को वैध मानती है या समयपूर्व रिहाई को लेकर कोई नया निर्देश जारी करती है। इस फैसले का असर न केवल आनंद मोहन के मामले पर, बल्कि भविष्य में गंभीर अपराधों में दोषियों की समयपूर्व रिहाई से जुड़े मामलों पर भी पड़ सकता है।
