झारखंड हाईकोर्ट का बड़ा फैसला: पारसनाथ पर्वत की पवित्रता बनी रहे, पर्यटन, मांसाहार और शराब पर पूर्ण प्रतिबंध

गिरिडीह ज़िले के प्रसिद्ध पारसनाथ पर्वत को लेकर झारखंड हाईकोर्ट ने एक ऐतिहासिक फैसला सुनाया है। कोर्ट ने साफ कहा है कि इस पवित्र स्थल की गरिमा बनाए रखने के लिए यहां किसी भी प्रकार का पर्यटन, शराब सेवन, मांसाहार, जानवरों को हानि पहुंचाना, और पर्यावरण को नुकसान पहुंचाने वाली गतिविधियाँ पूरी तरह से प्रतिबंधित रहेंगी।

यह फैसला ‘ज्योत’ नामक धार्मिक ट्रस्ट द्वारा दायर एक जनहित याचिका (PIL) के बाद आया है। याचिका में पारसनाथ पर्वत की धार्मिक महत्ता को ध्यान में रखते हुए इसे अतिक्रमण और अनैतिक गतिविधियों से बचाने की मांग की गई थी। कोर्ट ने 5 जनवरी 2023 को भारत सरकार द्वारा जारी किए गए ऑफिस मेमोरेंडम का कड़ा पालन करने का निर्देश दिया है, जो पर्यावरण संरक्षण अधिनियम 1986 की धारा 5 के अंतर्गत आता है।

पारसनाथ पर्वत का धार्मिक महत्व
जैन धर्म में यह स्थल उतना ही पवित्र है जितना हिंदुओं के लिए राम जन्मभूमि, बौद्धों के लिए बोधगया, सिखों के लिए स्वर्ण मंदिर, मुस्लिमों के लिए मक्का और ईसाइयों के लिए वेटिकन। यहां माने जाते हैं कि 24 में से 20 तीर्थंकरों ने यहीं मोक्ष प्राप्त किया। इसलिए जैन समुदाय इस पर्वत को ‘महातीर्थ’ मानता है।

सरकारी नीति और कोर्ट की सख्ती
2019 में ही पारसनाथ क्षेत्र को ‘इको-सेंसिटिव जोन’ घोषित किया जा चुका है। इसके तहत पर्यावरण को क्षति पहुंचाने वाली कोई भी गतिविधि जैसे होटल बनाना, लाउड म्यूजिक, जानवरों को नुकसान, पेड़ों को काटना, प्लास्टिक का उपयोग, इत्यादि पर पहले से रोक है। कोर्ट ने पाया कि इन नियमों को जमीन पर लागू नहीं किया गया और सरकार ने इस क्षेत्र को अब भी पर्यटन स्थल जैसा ट्रीट किया, जो कि नियमों के खिलाफ है।

कोर्ट के निर्देश

2019 और 2023 के पर्यावरण से संबंधित नोटिफिकेशन का सख्ती से पालन किया जाए।

पारसनाथ पर हो रही सभी गैर-कानूनी गतिविधियों को तत्काल रोका जाए।

गिरिडीह के पुलिस अधीक्षक को निर्देश दिया गया है कि सुरक्षा बलों की संख्या बढ़ाई जाए ताकि सभी नियमों का पालन सुनिश्चित हो सके।

जिला विधिक सेवा प्राधिकरण के सचिव को निर्देशित किया गया है कि वह पर्वत क्षेत्र का निरीक्षण करें और वहाँ मौजूद निर्माणों की वैधता जांचें।

आदिवासी समुदाय को लेकर कोर्ट की टिप्पणी
याचिका के दौरान यह भी मुद्दा उठा कि पारसनाथ पर्वत संथाल आदिवासी समुदाय के लिए भी धार्मिक महत्व रखता है। इस पर कोर्ट ने याचिकाकर्ता के उस आश्वासन को रिकॉर्ड में लिया जिसमें उन्होंने आदिवासी परंपराओं और अधिकारों का पूरा सम्मान करने की बात कही।

इस ऐतिहासिक फैसले से यह स्पष्ट हो गया है कि पारसनाथ पर्वत एक धार्मिक स्थल है, न कि पर्यटन का केंद्र, और इसकी पवित्रता बनाए रखने के लिए कड़े कदम उठाए जाएंगे
