झारखंड हाईकोर्ट ने चतरा शहर को NH-99 (न्यू NH-22) और NH-100 (न्यू NH-522) से जोड़ने वाली प्रस्तावित बाईपास सड़क के निर्माण पर अंतरिम रोक लगा दी है। मामले की सुनवाई जस्टिस आनंद सेन की एकल पीठ कर रही है। यह मामला सड़क के मौजूदा एलाइनमेंट को बदलकर वैकल्पिक मार्ग अपनाने की मांग से जुड़ा है, ताकि बड़ी संख्या में पूर्ण विकसित पेड़ों को काटे जाने से बचाया जा सके। झारखंडियों खासकर प्रकृति प्रेमियों के लिए खुशखबरी है.
याचिकाकर्ता की ओर से (CASE: Suresh Sao v. State of Jharkhand & Ors. | W.P.(C) No. 4394 of 2023) अदालत को बताया गया कि यदि सड़क का मार्ग बदला जाता है, तो उसकी जमीन पर मौजूद करीब 300 पूर्ण विकसित पेड़ों को बचाया जा सकता है।
इसके बाद हाईकोर्ट ने अधिकारियों को मौके का निरीक्षण कर यह जानकारी देने का निर्देश दिया था कि मौजूदा एलाइनमेंट में कितने पेड़ों की कटाई आवश्यक होगी और क्या सड़क के लिए कोई वैकल्पिक मार्ग संभव है। राज्य सरकार की ओर से कोर्ट को बताया गया कि मौजूदा एलाइनमेंट के तहत वन क्षेत्र सहित कुल 13,681 पूर्ण विकसित पेड़ों को काटना पड़ेगा।
JHC : विकास के नाम पर पेड़ों की अंधाधुंध कटाई नहीं होगी
इतनी बड़ी संख्या में पेड़ों की कटाई पर हाईकोर्ट ने गंभीर चिंता जताई। अदालत ने कहा कि “जंगल सिर्फ पेड़ों का नाम नहीं है। इसमें जानवर, पक्षी, कीड़े-मकौड़े और अन्य जीव-जंतु भी शामिल हैं। यह पूरा एक Ecosystem है।” कोर्ट ने यह भी कहा कि ये पेड़ केवल Canopy नहीं, बल्कि पर्यावरण के “Lungs” हैं और विकास के नाम पर इन्हें अंधाधुंध नहीं काटा जा सकता।
हाईकोर्ट ने Compensatory Afforestation के तहत नए पौधे लगाए जाने के तर्क पर भी महत्वपूर्ण टिप्पणी की। अदालत ने कहा कि नए पौधे पुराने और पूर्ण विकसित पेड़ों तथा उनके पूरे Ecosystem की तत्काल भरपाई नहीं कर सकते। एक विकसित जंगल का स्वरूप तैयार होने में कई दशक, यहां तक कि 100 साल से अधिक समय लग सकता है।
इस दौरान पर्यावरण और पारिस्थितिकी को होनेवाला नुकसान अपूरणीय हो सकता है। कोर्ट ने यह सवाल भी उठाया कि कुछ मील की दूरी कम करने के लिए जंगल, वनस्पति, जीव-जंतु और वन्यजीवों को नुकसान पहुंचाना आखिर कितना उचित है।
एजेंसियों को वैकल्पिक मार्ग तलाशने को कहा गया
2 सितंबर 2026 के पत्र में 13,681 पेड़ों की कटाई की जानकारी सामने आने के बाद हाईकोर्ट ने पर्यावरण, वन एवं जलवायु परिवर्तन मंत्रालय (MoEFCC) और सड़क परिवहन एवं राजमार्ग मंत्रालय (MoRTH) को भी मामले में पक्षकार बनाने का निर्देश दिया।
अंतरिम आदेश के तहत अदालत ने अगले आदेश तक चिन्हित पेड़ों की कटाई पर रोक लगा दी है और उन हिस्सों में सड़क निर्माण पर भी रोक रहेगी, जहां इन पेड़ों को काटना आवश्यक है। हालांकि संबंधित एजेंसियों को सड़क के मौजूदा एलाइनमेंट पर दोबारा विचार करने और वैकल्पिक मार्ग तलाशने की स्वतंत्रता दी गई है।
हाईकोर्ट का यह फैसला सिर्फ चतरा की सड़क परियोजना से जुड़ा मामला नहीं, बल्कि विकास और पर्यावरण के बीच संतुलन को लेकर एक महत्वपूर्ण संदेश भी है। अदालत ने स्पष्ट किया कि वर्तमान पीढ़ी पर्यावरण की Custodian है और आने वाली पीढ़ियों के लिए प्रकृति को सुरक्षित रखना उसकी जिम्मेदारी है।
