रांची : रांची के पूर्व उपायुक्त छवि रंजन झारखंड हाईकोर्ट ने झटका दिया है. गुरुवार को हाईकोर्ट ने उनके उस आदेश को ख़ारिज कर दिया है, जिसमें उन्होंने बजरा मौजा की 7 एकड़ से ज्यादा भूमि के म्यूटेशन का आदेश पारित किया था. प्रार्थी चंदन कुमार ने हाईकोर्ट में याचिका दाखिल कर कहा था कि रांची के पूर्व डीसी छवि रंजन ने 7 एकड़ जमीन का 83 साल की लगान रसीद एक ही दिन काटने का आदेश दे दिया था, जो पूर्णत: नियम विरुद्ध है. इस पूरे प्रकरण में दक्षिणी छोटानागपुर प्रमंडल के तत्कालीन आयुक्त नितिन मदन कुलकर्णी ने रांची डीसी भूमिका पर कई सवाल उठाए थे. श्री कुलकर्णी ने हेहल अंचल की 7.16 एकड़ जमीन पर कथित कब्जा मामले में रांची डीसी छवि रंजन की भूमिका को संदिग्ध माना था. श्री कुलकर्णी ने कहा था कि डीसी कोर्ट के आदेश के तुरंत बाद जमीन की बिक्री और फिर स्थानीय पुलिस की मदद जमीन पर चाहरदीवारी करवाना, ये सारे काम पूर्व नियोजित थे. कुलकर्णी ने मामले की सघन जांच के बाद अपनी रिपोर्ट में उसका उल्लेख किया है. 

कुलकर्णी ने छवि रंजन की भूमिका को संदिग्ध माना था

दरअसल, रांची डीसी ने जिस 7.16 एकड़ जमीन का 83 सालों की लगान रसीद काटने का आदेश दिया था. उसकी सरकारी कीमत करीब 25 करोड़ है, जबकि जमीन कारोबार से जुड़े लोगों के अनुसार इस भूखंड की वर्तमान कीमत इसकी दुगनी बता रहे हैं. रांची डीसी ने जमीन के संबंध में फैसला सुनाने का आधार एक पंचनामा को माना था. इसमें ग्रामीणों के हस्ताक्षर व अंगूठे के निशान थे. पंचनामा 13 मार्च 2016 को तैयार किया गया. इस पंचनामे के मुताबिक जमीन पर विनोद कुमार सिंह का कब्जा है. इसी आधार पर डीसी ने जमीन की जमाबंदी विनोद कुमार सिंह के पक्ष में करने का आदेश दे दिया. इसके बाद यह मामला आयुक्त के पास पहुंचा. आयुक्त ने अपनी जांच रिपोर्ट में लिखा है कि हेहल अंचल के सीओ ने 7 नवंबर 2020 को अचानक से इस पंचनामे को डीसी के पास भेजा. चार साल बाद इस पंचनामा को सीधे डीसी कार्यालय को क्यों भेजा गया, यह स्पष्ट नहीं है. इससे पहले भी इस जमीन को लेकर जिला प्रशासन की दूसरी अदालतों में सुनवाई हुई थी. लेकिन विनोद कुमार सिंह ने इस पंचनामा का जिक्र कहीं नहीं किया. आयुक्त ने बिहार टीनेट्स होल्डिंग्स (मेंटेनेंंस ऑफ रिकॉर्ड 1973) में जमीन के नामांतरण, दाखिल-खारिज की प्रक्रिया निर्धारित है. इस एक्ट की धारा 16 में यह बात स्पष्ट है कि पुनरीक्षण के दौरान कोई नया तथ्य, जो नीचे के न्यायालय में नहीं रखे गये थे, उसे डीसी की अदालत में नहीं रखा जा सकता. हां, ऐसे मामले में डीसी के पास इस तरह के तथ्यों की समीक्षा के लिये मामले को रिमांड किया जा सकता था. 

कमिश्नर ने डीसी कोर्ट के आदेशों की जांच की अनुशंसा की है

उल्लेखनीय है कि पूर्व कमिश्नर ने छवि रंजन के कोर्ट द्वारा एक साल में जमीन से जुड़े आदेशों की जांच की अनुशंसा की थी. इतना ही नहीं कमिश्नर ने डीसी के खिलाफ अनुशासनात्मक और विभागीय कार्रवाई की भी सिफारिश की थी. उन्होंने अपनी रिपोर्ट कड़ी टिप्पणी की थी. कमिश्नर की रिपोर्ट कहा गया कि जमीन के गोरखधंधे में थानेदार, सीओ से लेकर डीसी तक शामिल हैं। जमीन पर अवैध तरीके से कब्जा दिलाने के लिए सरकारी मशीनरी का भी धड़ल्ले से दुरुपयोग हुआ. रिपोर्ट में कहा गया है कि रांची डीसी ने अपने पद का दुरुपयोग करते हुए रवि सिंह भाटिया व श्याम सिंह के पक्ष में अवैधानिक आदेश पारित किया और खाता नंबर 140 की 7.16 एकड़ जमीन की जमाबंदी खोलने का आदेश दिया। रिपोर्ट में कहा गया है कि बजरा की 7.16 एकड़ जमीन की सरकारी दर 29.88 करोड़ है। लेकिन इसे सिर्फ 15.10 करोड़ में बेची गई। चूंकि यह जमीन प्राइम लोकेशन पर है। विक्रेता को सर्किल रेट से अधिक कीमत मिल सकती थी। इसके बावजूद आधी कीमत पर जमीन बेचना संदिग्ध लगता है। इसलिए इसकी अलग से जांच कराई जाए।

छविरंजन ने गलत ढंग से जमाबंदी खोलने का आदेश दिया था  

प्रमंडलीय आयुक्त ने अपनी रिपोर्ट में यह भी कहा है कि रांची डीसी ने जमीन पर कब्जा दिलाने के लिए सरकारी मशीनरी का दुरुपयोग किया। मजिस्ट्रेट और 150 पुलिसकर्मियों को प्रतिनियुक्त कर जमीन पर अवैध तरीके से चहारदीवारी का निर्माण कराया। पुलिसकर्मियों की प्रतिनियुक्ति पर सरकारी राशि खर्च हुई। इसलिए इस राशि की वसूली डीसी के वेतन और जमीन की खरीदारी करनेवाले रवि भाटिया व श्याम सिंह से की जाए। दरअसल, जमीन की गलत तरीके से जमाबंदी किए जाने की शिकायत सरकार को मिली थी। इसके बाद सरकार ने प्रमंडलीय आयुक्त को जांच कर रिपोर्ट देने को कहा था। आयुक्त ने रिपोर्ट में कहा है कि विनोद कुमार ने वर्ष 2016 में इस जमीन के म्यूटेशन के लिए हेहल अंचल में आवेदन दिया था। सीओ ने आवेदक का दखल न होने की बात कहते हुए आवेदन रद्द कर दिया। डीसीएलआर ने भी विनोद के आवेदन को रद्द कर दिया था। इसके बाद विनोद ने डीसी छवि रंजन के कोर्ट में रिवीजन के लिए आवेदन दिया। डीसी ने हेहल सीओ द्वारा दिए गए सादा पंचनामा के आधार पर विनोद कुमार सिंह के नाम पर जमीन की जमाबंदी खोलने का आदेश दे दिया। डीसी कोर्ट के आदेश के अगले ही माह विनोद सिंह ने मार्च 2021 में जमशेदपुर के रवि सिंह भाटिया और श्याम सिंह को यह जमीन 15.10 करोड़ में बेच दी।

बहरहाल, कोर्ट ने जमीन मालिक के पक्ष में अपना फैसला दे दिया है. पर कुलकर्णी द्वारा सरकार को सौंपी गई रिपोर्ट की फाइल साल भर बाद भी धूल फांक रही है. उन्होंने छवि रंजन के डीसी कोर्ट से पिछले एक साल में दिए गए जमीन से जुड़े सभी आदेशों की जांच की भी सिफारिश सरकार से की है. अब देखना है कोर्ट के आदेश के बाद सरकार क्या रुख अपनाती है…?
