SC का जातिगत सर्वे पर रोक लगाने से इंकार, यथास्थिति का आदेश जारी करने का निवेदन भी ठुकराया, जनवरी में होगी अगली सुनवाई

नई दिल्ली : बिहार में जातीय गणना से बौखलाई केंद्र सरकार को सुप्रीम कोर्ट से भी राहत नहीं मिली. बिहार की नीतीश कुमार सरकार ने हाल ही में जाति आधारित सर्वे के आंकड़े को सार्वजानिक किया था। इसके बाद कोई इस आंकड़े को गलत तो कोई सही बता रहा है। जब यह मामला शीर्ष अदालत में पहुंचा तो शुक्रवार को इस पर सुनवाई हुई। सुनवाई के दौरान अदालत ने जाति आधारित सर्वे पर रोक लगाने से साफ इनकार कर दिया और अगली सुनवाई अगले साल जनवरी में करने के लिए कहा। कोर्ट ने कहा कि हम किसी राज्य सरकार को नीति बनाने या काम करने से नहीं रोक सकते। सुनवाई में उसकी समीक्षा कर सकते हैं। हाईकोर्ट ने विस्तृत आदेश पारित किया है और हमें भी विस्तार से ही सुनना होगा। अदालत में अपना पक्ष रखते हुए वकील ने कहा कि सर्वे की प्रक्रिया ही निजता के अधिकार का हनन थी। इस दलील पर कोर्ट ने कहा कि हम नोटिस जारी कर रहे हैं और अगली सुनवाई जनवरी में होगी। इसके बाद वकील द्वारा यथास्थिति का आदेश जारी करने का निवेदन किया गया तो, जज ने कहा कि हम किसी सरकार को नीति बनाने से नहीं रोक सकते, लेकिन लोगों के निजी आंकड़े भी सार्वजनिक नहीं होने चाहिए।

गैरभाजपा सरकारों वाले राज्यों में गया सकारात्मक संदेश

सुप्रीम कोर्ट द्वारा बिहार जाति-आधारित सर्वेक्षण पर रोक लगाने से इनकार करने पर, बिहार के मंत्री अशोक चौधरी ने कहा कि यह हमारे जैसे लोगों के लिए खुशी की बात है जो, इसका (जाति-आधारित सर्वेक्षण) समर्थन करते हैं। जो लोग जाति-आधारित जनगणना का समर्थन करते हैं और नीतीश कुमार के साथ राजनीति में हैं – जिन्होंने सबसे पिछड़ों को पंचायत राज प्रणाली में आरक्षण प्रदान करके सशक्त बनाने का प्रयास किया. दलितों और महिला आरक्षण को सशक्त बनाने का प्रयास किया। सुप्रीम कोर्ट के आदेश के बाद अब बिहार की जातीय गणना गैरभाजपा सरकारों वाले राज्यों में सकारात्मक संदेश गया है. झारखंड सरकार ने जातीय गणना के प्रति सकारात्मक रुख अपनाया है.
