भजंत्री को रांची का डीसी बनाने पर चुनाव आयोग को आपत्ति: CS को 15 दिन के अंदर जवाब भेजने का आदेश

रांची :  मंजूनाथ भजंत्री को रांची का डीसी बनाना विवाद का विषय बन गया है. चुनाव आयोग ने मंजूनाथ भजंत्री को रांची डीसी बनाये जाने के फैसले को हाईकोर्ट के आदेश का उल्लंघन बता कर सरकार की कार्यशैली पर ही सवाल उठा दिया है. आयोग ने मुख्य सचिव को 15 दिनों में कार्रवाई रिपोर्ट आयोग को भेजने का आदेश दिया है. इस संबंध में चुनाव आयोग ने झारखंड के मुख्य सचिव को पत्र लिखा है. भारतीय निर्वाचन आयोग ने अपने पत्र में मुख्य सचिव को छह दिसंबर 2021 के आदेश का अनुपालन करने का कहा है, जिसमें उसने देवघर के तत्कालीन डीसी मंजूनाथ भजंत्री को पद से हटाने, विभागीय कार्यवाही करने और आयोग की अनुमति के बिना चुनाव कार्य से जुड़े पद पर पदस्थापित नहीं करने का आदेश दिया था.

आयोग के आदेश के बावजूद भजंत्री को नहीं हटाया गया था

मुख्य सचिव को लिखे पत्र में चुनाव आयोग ने कहा है कि मधुपुर उपचुनाव में तत्कालीन डीसी ने आयोग के वोटर टर्न आउट एप और प्रेस कांफ्रेंस में अलग-अलग आंकड़ा पेश करने की वजह से उन्हें 26 अप्रैल 2021 को उपायुक्त के पद से हटा दिया गया था. लेकिन आचार संहिता समाप्त होने के बाद सरकार ने उन्हें फिर से देवघर डीसी के पद पर पदस्थापित करने का आदेश दिया था. इसके करीब छह माह बाद मुख्य निर्वाची अधिकारी (सीइओ) ने आयोग को रिपोर्ट भेजी थी. इस रिपोर्ट में सीइओ ने बताया कि डीसी ने आचार संहिता खत्म होने के बाद आचार संहिता उल्लंघन के आरोप में सांसद निशिकांत दुबे के खिलाफ प्राथमिकी दर्ज की. चुनाव आयोग ने सीइओ की रिपोर्ट पर डीसी से स्पष्टीकरण मांगा था. लेकिन उन्होंने संतोषप्रद जवाब नहीं मिलने के बाद छह दिसंबर 2021 को आयोग ने उपायुक्त को हटाने और भविष्य में आयोग की अनुमति के बिना चुनाव से जुड़े काम में पदस्थापित नहीं करने का आदेश दिया था. लेकिन फिर भी सरकार ने उन्हें पद से नहीं हटाया.

हाईकोर्ट ने चुनाव आयोग के आदेश को सही करार दिया

चुनाव आयोग ने अपने पत्र में लिखा है कि 23 दिसंबर 2021 को कार्मिक विभाग की ओर से आयोग को एक पत्र लिखा गया. इसमें कहा गया कि आयोग अपना आदेश वापस ले, क्योंकि आचार संहिता समाप्त होने के बाद इस तरह का आदेश देने का अधिकार आयोग को नहीं है. इसके बाद आयोग ने 15 दिसंबर 2022 को पत्र भेज कर इस मामले में मुख्य सचिव की राय मांगी. लेकिन उन्होंने अपनी राय नहीं दी. इसके बाद 26 दिसंबर 2022 को मंजूनाथ भजंत्री से जिला निर्वाचन पदाधिकारी का काम वापस ले लिया गया था और उसे डीडीसी को सौंप दिया. हालांकि मंजूनाथ भजंत्री ने  आयोग के आदेश को चुनौती देते हुए हाईकोर्ट में याचिका (5716/22) दायर की थी. मंजूनाथ भजंत्री ने अपनी याचिका में चुनाव आयोग के आदेश को नियम के विरुद्ध बताया था. सिंगल बेंच ने भजंत्री की याचिका को स्वीकार कर ली. इसके बाद आयोग ने सिंगल बेंच के फैसले के खिलाफ हाईकोर्ट में एलपीए (244/24) दायर की. हाईकोर्ट ने सुनवाई के बाद 30 सितंबर 2024 को अपना फैसला सुनाया और चुनाव आयोग के आदेश को सही करार दिया. न्यायालय ने अपने आदेश में कहा था कि आयोग का आदेश नहीं मानना संविधान के मूल ढांचे पर प्रहार करने जैसा है. उसका निर्देश मानना राज्य के लिए बाध्यकारी है.
