समाज में बढ़ती असमानता: भारतीय न्यायपालिका के एकपक्षीय फैसले और उनके प्रभाव

रांची – भारत में परिवार और विवाह से संबंधित कानूनों की प्रक्रिया में समय-समय पर विवाद उठते रहे हैं। खासकर जब बात घरेलू हिंसा, दहेज और महिला उत्पीड़न से जुड़ी हो, तो न्यायपालिका पर आरोप लगाए जाते रहे हैं कि वह इन मामलों में पक्षपाती फैसला सुनाती है। यह स्थिति ऐसी बन गई है कि अब यह महसूस किया जा रहा है कि न्यायालयों में महिलाओं के पक्ष में फैसले एकतरफा होते हैं, जिनका पुरुषों के लिए कोई समुचित स्थान नहीं होता।

वर्तमान भारतीय न्याय व्यवस्था पर विशेषकर दहेज और घरेलू हिंसा के मामलों में पुरुषों के खिलाफ निरंतर बढ़ते आरोपों की वजह से गंभीर प्रश्न उठने लगे हैं। समाज में यह महसूस किया जा रहा है कि अदालतें अक्सर बिना किसी ठोस सबूत के महिलाओं के पक्ष में फैसले देती हैं, जबकि पुरुषों को अपनी बात रखने का अवसर तक नहीं दिया जाता।

अतुल सुबाश का मामला और न्यायपालिका का पक्षपाती रवैया

हाल ही में बंगलौर के एक ए.आई. इंजीनियर, अतुल सुबाश की आत्महत्या ने इस मुद्दे को और भी प्रकट कर दिया है। अतुल पर उनकी पत्नी ने दहेज के लिए उत्पीड़न करने का आरोप लगाया था। इस मामले में, अदालत ने अतुल को बेवजह परेशान किया , जबकि अतुल का कहना था कि यह आरोप पूरी तरह से झूठे थे। अतुल भविष्य के कानूनी झंझटों से तंग आकर अतुल ने आत्महत्या कर ली। इस मामले ने भारतीय न्यायपालिका की निष्पक्षता और दहेज उत्पीड़न से संबंधित कानूनों के दुरुपयोग के मुद्दे को एक बार फिर उजागर किया है।

पुरुषों के लिए न्याय की कमी

भारत में महिलाओं के अधिकारों की रक्षा करने के लिए कई कानून बनाए गए हैं, जैसे कि घरेलू हिंसा से बचाव कानून (Domestic Violence Act) और दहेज निषेध अधिनियम। हालांकि, इन कानूनों के दुरुपयोग की घटनाएँ भी सामने आ रही हैं। कई मामलों में महिलाएं इन कानूनों का गलत इस्तेमाल कर रही हैं, जिससे पुरुषों के जीवन में तनाव और मानसिक उत्पीड़न बढ़ रहा है। ऐसा नहीं है कि हर महिला उत्पीड़ित होती है, लेकिन जिन मामलों में झूठे आरोप लगाए जाते हैं, वहां पुरुषों को न्याय पाने में काफी मुश्किलें आती हैं।

क्या करें पुरुष?

यदि कोई हिंदू लड़का विवाह करना चाहता है और उसे इन मुद्दों से बचना है, तो उसे कुछ कानूनी सावधानियाँ अपनानी चाहिए।

1. प्री-नूप्टियल एग्रीमेंट: एक कानूनी दस्तावेज तैयार करें जिसमें वित्तीय मामलों, संपत्ति और किसी भी अन्य विवादों को स्पष्ट रूप से रखा जाए। यह बाद में किसी भी झगड़े या तलाक के समय सहायक हो सकता है।
2. विवाह पंजीकरण: अपने विवाह को कानूनी रूप से पंजीकृत कराएं। इससे आपके रिश्ते का कानूनी रेकॉर्ड रहेगा, जो भविष्य में मददगार हो सकता है।
3. साक्षियों की मौजूदगी: अगर आपको लगता है कि कोई विवाद उत्पन्न हो सकता है, तो साक्षियों को शामिल करें। यह बाद में आपके पक्ष में सबूत के रूप में काम आ सकता है।
4. दहेज से संबंधित कोई समझौता न करें: दहेज प्रथा भारत में कानूनी रूप से अपराध है। किसी भी प्रकार के दहेज या उसकी मांग से बचें और इसे स्पष्ट रूप से मना करें।
5. घर में उचित भूमिका तय करें: विवाह के बाद दोनों की भूमिका और जिम्मेदारियाँ स्पष्ट रूप से तय करें। इससे किसी भी भविष्य के झगड़े से बचने में मदद मिल सकती है।
6. महिला अधिकारों का सम्मान करें, लेकिन धोखाधड़ी से बचें: महिला उत्पीड़न या घरेलू हिंसा के आरोप झूठे हो सकते हैं, इसलिए इन आरोपों से बचने के लिए पत्नी के साथ सम्मान और समझदारी से पेश आना जरूरी है।

लोकगीत – ‘सावधान रहो!’

वहीं, पूर्वी भारत के प्रसिद्ध लोक गायिका बलेश्वर यादव जी का एक प्रसिद्ध गीत, “त्रिया (लड़की) गोरी हो या काली , लेकिन छि**ल  न मिले ” एक ओर चेतावनी के रूप में गाया जाता है। इस गीत में यह संदेश छिपा है कि शादी में समझदारी और विवेकपूर्ण निर्णय लेना चाहिए, न कि भावनाओं या किसी झूठी छवि पर आधारित। यह गीत एक ऐसा संदेश देता है कि केवल सुंदरता या जाति-धर्म से अधिक जरूरी है जीवन साथी का चरित्र और व्यवहार।

निष्कर्ष:

यह कहना गलत नहीं होगा कि भारतीय न्यायपालिका में अब महिलाओं के अधिकारों को सशक्त बनाने के साथ-साथ पुरुषों के लिए न्याय की स्थिति सुधारने की भी आवश्यकता है। अगर ये मुद्दे हल नहीं होते, तो और अधिक लोग ऐसे अत्याचारों के शिकार हो सकते हैं, जिससे समाज में एक प्रकार की असमानता पैदा हो सकती है। न्यायपालिका को यह सुनिश्चित करना चाहिए कि आरोपों की सुनवाई निष्पक्ष और न्यायपूर्ण हो, और किसी भी मामले में पक्षपाती रवैया नहीं अपनाया जाए।
