कमिश्नर ने सीओ के अधूरे प्रतिवेदन पर जताया एतराज, तीन दिनों के अंदर फिर से मांगी पूरी रिपोर्ट

दक्षिणी छोटानागपुर के कमिश्नर नितिन मदन कुलकर्णी ने रसूखदारों द्वारा हड़पी गई भुईँहरी जमीन को लेकर गंभीर हैं. 11 मई को आयुक्त कार्यालय द्वारा बड़गाई अंचल कार्यालय से मांगे गए आधे-अधूरे प्रतिवेदन पर ऐतराज जताया है. बड़गाई सीओ द्वारा 25 मई को आयुक्त कार्यालय को भेजे गए प्रतिवेदन में सिर्फ लॉविस्टा अपार्टमेंट को फोकस किया गया है, पर पल्स अस्पताल को छोड़ दिया गया है. इसके बाद कमिश्नर ऑफिस ने (पत्रांक 10-14/1529, 30 मई 2022) सोशल एक्टिविस्ट इंद्रदेव लाल से प्राप्त आवेदन के जांच प्रतिवेदन के क्रम में पूरक सूचनाएं उपलब्ध कराने का आदेश बड़गाई सीओ को दिया है. आयुक्त कार्यालय ने बड़गाई अंचल कार्यालय के जवाब के आलोक में (पत्रांक 465(ii) 25 मई 2022) फिर तीन बिंदुओं पर जवाब मांगा है. सीओ के प्रतिवेदन की कुल पृष्ठ संख्या 19 है. कमिश्नर ने अंचल कार्यालय को तीन दिनों के अंदर प्रतिवेदन उपलब्ध कराने को कहा है.

सीओ के प्रतिवेदन में भूखंड पर संरचनाओं का जिक्र नहीं

दरअसल, प्रासंगिक पत्र द्वारा उपलब्ध कराए गए प्रतिवेदन से यह स्पष्ट नहीं हो पा रहा है कि दाखिल-खारिज वाद सं-1185/2017-18 एवं 1079/2017-18 को अस्वीकृत तो कर दिया गया है, परंतु उक्त वाद में निहित भूखंड पर अभी किसका दखल-कब्जा है अथवा उसपर किसी प्रकार की संरचना का निर्माण किया गया है. यह स्पष्ट नहीं है. इसलिए कमिश्नर ने स्थल निरीक्षण कराकर फोटोग्राफ के साथ यह प्रतिवेदित किया जाए कि उक्त दोनों नामांतरण वाद में निहित भूखंड पर किनका दखल-कब्जा है? भूखंड खाली है अथवा उसपर किसी प्रकार का निर्माण हुआ है एवं निर्माण का वर्ष क्या है?

भुईंहरी जमीन की प्रकृति में बदलाव कैसे हुआ?

दूसरा, आपके द्वारा मौजा मोराबादी, थाना नं-192 के खाता सं-160, 161 एवं 162 के ऑनलाइन खतियान की प्रति संलग्न कर भेजी गयी है, जो किस्म बकास्त भुईंहरी है. इनके विभिन्न प्लॉटों एवं रकबा का विवरण तो है, परंतु इन भूखंडों पर वर्तमान में दखल-कब्जा, इनके खाली रहने अथवा इसपर हुए निर्माण की सूचना अनुपलब्ध है. अत: खाता सं- 160, 161 एवं 162 के विभिन्न प्लॉटों पर वर्तमान दखल-कब्जा किनका-किनका है, यह बताने की कृपा की जाए. साथ ही मोराबादी मौजा के सभी बकास्त भुईंहरी, खाता एवं प्लॉट संख्या में निहित भूमि के खाली रहने अथवा उसपर हुए विनिर्माण की सूचना उपलब्ध करायी जाए, ताकि इसके आगे की जांच करायी जा सके कि बकास्त भुईंहरी जमीन की प्रकृति में बदलाव कैसे हुआ एवं इस कार्य में सरकार तंत्र की संलिप्तता है अथवा नहीं? और तीसरा, श्री लाल के परिवाद पत्र में जिन 5 जमाबंदीदारों के नाम अंकित हैं, उनके खाता, खेसरा, रकबा एवं किस्म जमीन का उल्लेख आपके प्रतिवेदन में नहीं है. इनका भी उल्लेख अपने प्रतिवेदन में किया जाए.

लॉविस्टा अपार्टमेंट की फोटोग्राफी भेजी गई

दरअसल, बड़गाई अंचल कार्यालय द्वारा आयुक्त कार्यालय में 25 मई 2022 को भेजे गए जवाब से कमिश्नर संतुष्ट नहीं हुए हैं. इसलिए पुन: बड़गाई सीओ को उक्त पत्र भेजा गया है. बता दें कि पूर्व में भेजे गए पत्र में भुईंहरी जमीन पर निर्मित लॉविस्टा अपार्टमेंट की फोटोग्राफी भेजी गई है, जबकि भुईंहरी जमीन पर ही निर्मित पल्स अस्पताल के बारे में सीओ ने उल्लेख नहीं किया है. सीओ के जांच प्रतिवेदन में दाखिल-खारिज वाद सं-1185/17-18, आवेदक राजकुमार जैन, पिता-हरकचंद जैन से संबंधित है, जो मौजा मोराबादी, खाता सं-157, प्लॉट नं-1164, रकबा 16 डिसमिल में गैरमजरुआ आम दर्जा जमीन रास्ता होने के कारण अस्वीकृत किया गया है. इसके अलावा दाखिल-खारिज वाद सं-1079/17-18 आवेदिका पूजा पोद्दार पति मिलन पोद्दार के नाम दर्ज हैं, जो मौजा-मोराबादी. थाना सं-192, खाता सं-161,प्लॉट सं-1138, रकबा-1.3 डिसमिल एवं खाता सं-162, प्लॉट सं-1137, रकबा-1.3 डिसमिल से संबंधित है. उक्त रकबा अपार्टमेंट लॉविस्टा अवस्थित एक फ्लैट का आनुपातिक रकबा है, जिसे तत्कालीन अंचलाधिकारी द्वारा बकास्त भुईंहरी खाते की भूमि जो सरकार में निहित नहीं है, के आधार पर अस्वीकृत किया गया है.

लॉविस्टा अपार्टमेंट मिलन पोद्दार ग्रुप ने बनवाया

मौजा मोराबादी, खाता सं-161, प्लॉट संख्या-1138, एवं खाता सं-162, प्लॉट सं-1137,आरएस खतियान में बकास्त भुईंहरी दर्ज है. उक्त दोनों प्लॉट के अंश (लगभग 30 डिसमिल) पर लॉविस्टा अपार्टमेंट निर्मित है. जिसे मिलन पोद्दार ग्रुप के द्वारा बनवाया गया है. नामांतरण वाद सं-1079/2017-18 इसी अपार्टमेंट से संबंधित है.

अशोक कुमार जैन वगैरह पंजी-II में निम्नलिखित विवरणी दर्ज हैं-

रैयत अशोक कुमार जैन, दाखिल-खारिज वाद सं-4आर-27/71-72, वोल्यूम नं-III- पृष्ठ सं-239, 2 अनिल कुमार जैन, 3 आर-27/71-72, वोल्यूम नं-III- पृष्ठ सं-231, 3. विजय कुमार जैन,1171आर-27/89-84, वोल्यूम नं-IX-36, रमेश कुमार जैन, 7आर-27/71-72, वोल्यूम नं-III-233 एवं वरुण बक्सी, 194आर-27/66-67, वोल्यूम नं-III-145 है. बड़गाई सीओ ने प्रतिवेदन के अंत में कहा है कि बड़गाई अंचल कार्यालय की स्थापना 1 जनवरी 2016 को हुई है. अत: संबंधित अभिलेख कार्यालय में उपलब्ध नहीं है. उक्त अभिलेख की मांग जिला अभिलेखागार, रांची से इस कार्यालय के पत्रांक-464(ii)/25मई 2022 द्वारा मांग की गई है. प्रश्नगत भूमि के ऑफलाइन खतियान उपलब्ध नहीं है.

उल्लेखनीय है कि रांची के अभिलेखागार में ऑफलाइन खतियानों के गायब होने या करने की सूचना मिलती रहती है. लंबे समय से पुराने खतियानों के पन्ने फाड़े गए हैं या उनपर स्याही गिरा दी गई है. बहरहाल, मोरहाबादी मौजा में भुईंहरी जमीन का वजूद भले मिटा कर गगनचुंबी इमारतें बना ली गई हों, पर कागज पर आज भी सैकड़ों एकड़ जमीन जैन बंधुओं की नहीं है. लॉविस्टा अपार्टमेंट भुईहरी जमीन पर निर्मित है, इसका प्रमाण तो जरूर मिल गया है.
