बंधु तिर्की ने कहा-जेलों में लंबे समय से बंद विचाराधीन कैदियों की रिहाई के मामले में हाईकोर्ट व सीएम सकारात्मक पहल करे

रांची : पूर्व मंत्री, झारखण्ड सरकार की समन्वय समिति के सदस्य एवं झारखण्ड प्रदेश कांग्रेस कमेटी के कार्यकारी अध्यक्ष बंधु तिर्की ने लंबे समय से विचाराधीन या लंबित केसों को लेकर राष्ट्रपति द्रौपदी मुर्मू द्वारा कुछ दिन पूर्व सुप्रीम कोर्ट के चीफ जस्टिस और प्रधानमंत्री नरेंद्र मोदी के सामने उठाए गए सवालों को ताजा कर दिया है. श्री तिर्की ने उसी मामले को आगे बढ़ाते हुए कहा कि रांची के बिरसा मुंडा केंद्रीय कारागार होटवार सहित पूरे प्रदेश के सभी जेलों में आदिवासियों, अनुसूचित जातियों, अन्य पिछड़े वर्गों, अल्पसंख्यकों सहित सभी वर्गों के अनेक वैसे कैदी न्याय की आस में बंद है, जिनका मामला लंबे समय से न्यायालय में सुनवाई के लिए विचाराधीन या लंबित है.

मानवता के आधार निर्णय लेने की जरूरत

श्री तिर्की ने कहा कि इसके साथ ही वैसे मामलों की संख्या भी अच्छी-खासी है, जहां मामूली अपराधों के लिए भी उन्हें जेल में रहते हुए लंबा समय बीत गया पर वैसे कैदी केवल आर्थिक या अन्य कारणों से सम्बंधित अदालतों की प्रक्रिया को औपचारिक रूप से पूरा नहीं कर पाये और अबतक जेल में बंद हैं. उन्होंने कहा कि  पूरे प्रदेश से उन्हें वैसी जानकारी और सूचनाएं मिलती हैं जो दिल को झकझोर देती है. कांग्रेस नेता ने कहा कि संवेदना एवं मानवता के आधार पर वैसे मामलों को गंभीरता से देखने की जरूरत है. उन्होंने झारखण्ड हाईकोर्ट, झारखण्ड राज्य विधिक सेवा प्राधिकरण (झालसा), मुख्यमंत्री हेमन्त सोरेन और राज्य सरकार के विधि विभाग के सक्षम अधिकारियों से इस मामले पर गंभीरता से विचार करने की अपील करते हुए कहा कि यदि इस दिशा में सार्थक और सकारात्मक कदम बढ़ते हैं तो न केवल सभी को बिना पक्षपात के शीघ्र न्याय देने का भारतीय संविधान का उद्देश्य प्राप्त करने में सहायता मिलेगी और अनेक लोगों की आँखों के सामने छाया अंधेरा छंटेगा बल्कि अनेक दृष्टि से कमजोर उन साधनहीन कैदियों की दुआ-प्रार्थना भी मिलेगी.

खर्चीली अदालती प्रक्रिया भी जिम्मेवार

उन्होंने कहा कि वर्षों एवं महीनों से विचाराधीन उन कैदियों के मामले भी बेचैन करनेवाले हैं, जहां छोटे-छोटे लड़ाई-झगड़े, मारपीट जैसे मामलों में गिरफ्तार अनेक विचाराधीन कैदी जेल में हैं और वे केवल अदालत की प्रक्रिया को पूरा न करने जैसे तकनीकी कारणों से ही जेल में बन्द हैं. इसके अलावा कई मामले वैसे भी हैं, जहां केवल कुछ पैसे के अभाव में उनके परिवार के सदस्य अदालती प्रक्रिया से बचते हैं क्योंकि उन्हें इस बात की चिंता है कि यदि अदालती कारवाई में उनके पास की थोड़ी-बहुत धन-संपत्ति भी यदि चली जायेगी तो वे अपना जीवन कैसे गुजारेंगे? उन्होंने कहा कि न्याय की आस में जेल में बन्द कई विचाराधीन कैदियों के मामले इस मामले में दिलचस्प एवं संवेदना से भरे हैं कि यदि उन मामलों में उन्हें आरोपित कर सजा भी सुनाई जाती है तो वह छोटी अवधि की होगी और उससे कई गुणा अधिक सजा वह पहले ही काट चुके हैं. उन्होंने कहा कि जेल में बन्द वैसे कैदियों और उनके परिवार की परेशानी को नज़रअंदाज़ नहीं किया जा सकता. श्री तिर्की ने कहा कि वे न्यायालय का पूरा सम्मान करते हैं और इस संदर्भ में वे झारखण्ड उच्च न्यायालय के न्यायाधीशों से सकारात्मक दिशा में प्रयास की अपेक्षा के साथ ही राज्य सरकार और विशेष रूप से सरकार के विधि विभाग के अधिकारियों से इस संबंध में विधि-सम्मत कार्रवाई की अपील के साथ एक विस्तृत प्रतिवेदन बनाकर राज्य सरकार के साथ ही न्यायालय के समक्ष प्रस्तुत करने की अपेक्षा रखते हैं जिससे अनेक कैदियों की आंख के सामने कायम अंधेरा कोहरा छंटे.
