गढ़वा: भंडरिया में रास्ते की भूमि में अवैध निर्माण: 3 साल के अंदर 6 बार आवेदन,फिर भी CO-SDO ने काम नहीं रोका, अब फरियादी ने लगाई डीसी से गुहार

गढ़वा : भंडरिया प्रखंड अंतर्गत ग्राम भंडरिया, टोला जोगिया मठ अनुमंडल रंका में रास्ते की भूमि में तार से घेराव कर एवं सर्वसाधारण की भूमि में अवैध मकान निर्माण की बार-बार शिकायत करने के बावजूद अभी तक कोई कार्रवाई नहीं किए जाने से शिकायतकर्ता परेशान हैं. शिकायतकर्ता भंडरिया अंचल में तीन साल के अंदर 6 बार आवेदन दे चुका है। 29 फरवरी 2020 को भंडरिया अंचल में आवेदन देने के बाद पूर्व बीडीओ सह सीओ विपिन भारती स्थल जांच निरीक्षण कर चुके हैं. इसके बाद वर्तमान सीओ मदन महली सर्वसाधारण भूमि का अबतक 5 बार जांच कर चुके हैं. इसके अलावा दो बार पुलिस दल-बल के साथ अवैध मकान निर्माण को रुकवाया जा चुका है। शिकायतकर्ता प्रशांत टोप्पो ने अंतत: गढ़वा डीसी को 8 अप्रैल को आवेदन देकर अविलंब हस्तक्षेप करने की गुहार लगाई है.

सीओ-एसडीओ ने अबतक कोई कार्रवाई नहीं की

बता दें कि मिंज परिवार द्वारा जीएम लैंड पर एक डिसमिल जमीन पर अवैध रूप से मकान बनाने की कोशिश की गई तो प्रशांत टोप्पो ने 20 दिसंबर 2022 को रंका दंडाधिकारी कार्यालय में धारा 144 प्रक्रिया आरंभ करने का आवेदन वकील के माध्यम से भी दिया है. इसके बाद एक बार रिमाइंडर भेजा गया. इस बीच अनुमंडल कार्यालय की ओर से न निर्माण कार्य रुकवाया गया और न धारा 144 लागू की गई. इसके अलावा सीओ द्वारा समय के साथ रिपोर्ट नहीं दी गई। बताया गया कि रास्ते भूमि पर हो रहे निर्माण कार्य होने से 7 घर के परिवार प्रभावित होंगे. वहां बसे अतुल मिंज,साइलेस मिंज और सुजीत मिंज (तीनों भाई) के खिलाफ विरोध करने से कई लोग ऐसे भी हैं,जो इनके समर्थन में उतर जाते हैं. इसके अलावा भंडरिया पंचायत के मुखिया विनय सिंह खरवार और वार्ड सदस्य रजनी टोप्पो ने शुरू में प्रशांत टोप्पो का साथ दिया था,पर अब वे भी पीछे हट गए हैं. बताया जाता है कि अतुल मिंज के परिवार से जेएमएम प्रखंड अध्यक्ष हरिदास तिर्की का मंत्री मिथलेश ठाकुर से अच्छे संबंध हैं. प्रशांत टोप्पो ने बताया कि हरिदास तिर्की ने उसे धमकाते हुए कहा कि ज्यादा होशियार बनते हो,केस करते हो, कुछ नहीं कर पाओगे…केस-फेस से कुछ नहीं होगा.

रास्ते की भूमि पर बेरोकटोक निर्माण कार्य जारी

कागजात की छानबीन करने और प्रशांत टोप्पो से बातचीत के क्रम में पता चला कि तीन साल से अंचल कार्यालय ने सिर्फ टरकाने का काम किया है. कार्रवाई के नाम पर लीपापोती की जा रही है. यही कारण है कि रास्ते की भूमि और सर्वासाधारण भूमि, जो कि जनता के कार्यों के लिए होता है, पर आवेदन देने के बाद भी लगातार मकान निर्माण कभी रूका नहीं और थाने में फरियाद करना भी अबतक बेकार साबित हुआ है. अधिकारियों को कई बार लिखित शिकायत देने के बावजूद रास्ते की भूमि और सर्वसाधारण भूमि पर 02 अवैध मकान निर्माण कर दिया गया है और किसी भी स्तर से अधिकारी अनुमंडल अधिकारी एवं दंडाधिकारी आंखें मूंदे हुए हैं. सीओ की जांच रिपोर्ट में कोई विवाद नहीं बताया जाना दुर्भाग्यपूर्ण है. अलबत्ता जांच रिपोर्ट कब्जाधारियों के फेवर में है। वहीं सीओ मदन माली इसी अवैध मकान निर्माण को पुलिस दल-बल के साथ दोबारा जांच कर तार से घेराबंदी एवं निर्माण कार्य को दो बार रुकवा चुकी है। हालांकि कागजात में 30 डिसमिल जमीन में से 6 डिसमिल जमीन गैरमजरुआ जमीन और सार्वजनिक रास्ता पंजी-2 में दर्ज है. मिंज परिवार ने 6 डिसमिल जमीन में से एक डिसमिल जमीन में मकान बनवा लिया गया है.शेेष 5 डिसमिल जमीन में निर्माण कार्य जारी है.

रास्ते की भूमि की फर्जी रसीद भी बनवा ली गई

कागजात के अनुसार रास्ते की भूमि एवं सर्वसाधारण की भूमि, जिसका खाता नं. 456, प्लॉट नं- 426 में कुल रकबा 6 डिसमिल है, जो शिकायतकर्ता के घर के सामने सर्वसाधारण भूमि है, जो पूर्व में भी सार्वजनिक कार्यों के लिए प्रयोग में लाने के लिए कई बार आवेदन दिया गया है. बताया गया कि उक्त भूमि पूर्व में कई लोग यहां मवेशी बांधने के काम में प्रयुक्त किया जा रहा था. लेकिन जब से इस जमीन पर दबंगों की नजर गड़ी है, तबसे इस जमीन को धीरे-धीरे कब्जा किया जाता रहा. मजेदार बात ये है कि भंडरिया अंचल से इसी भूमि की फर्जी रसीद भी बनवा ली गयी है। अवैध रूप से आवास निर्माण होने से रास्ता अवरुद्ध हो गया है. लोगों को आने-जाने में भारी परेशानी हो रही है. चार पहिया वाहन या कृषि कार्य में प्रयुक्त ट्रेक्टर भी यहां से घुसाना मुश्किल है। सीओ मदन महली पर आरोप है कि शिकायतकर्ता को ही घर से बेदखली का दबाव बनाते हुए उससे एक सहमति पत्र पर हस्ताक्षर करा लिया गया है। शिकायतकर्ता ने इसकी शिकायत ऑनलाइन के माध्यम से थाना को अवगत करा दिया है।

फरियादी को अब डीसी से ही कार्रवाई की उम्मीद

सवाल उठता है कि आखिर क्या कारण है कि सीओ-एसडीओ और भंडरिया थाना वहां चल रहे निर्माण कार्यों पर चुप्पी साधे हुए हैं. आखिर अंचल अधिकारी एवं दंडाधिकारी अवैध मकान निर्माणकर्ता पर इतने मेहरबान क्यों हैं? आरोप है कि अंचल अधिकारी मदन महली एवं अनुमंडल दंडाधिकारी रामनारायण सिंह अवैध निर्माणकर्ताओं से मिले हुए हैं। बताया जाता है कि अवैध मकान बनानेवाले भी आदिवासी परिवार से आते हैं, लेकिन उनकी राजनीतिक और प्रशासनिक पहुंच ऊपर तक है. प्रशांत टोप्पो पर मिंंज परिवार ने छेड़छाड़ व मारपीट का झूठा केस थाने में दर्ज करा रखा है. इसके बाद प्रशांत ने तुरंत काउंटर फाइल कर दिया. समझा जाता है कि प्रशांत टोप्पो को अगर पुलिस-प्रशासन का सहयोग नहीं मिला तो, यहां कभी भी कोई अप्रिय घटना घट सकती है. प्रशांत टोप्पो किसी अप्रिय घटना की आशंका से हमेशा डरा-सहमा सा रहता है. अब देखना है कि गढ़वा डीसी अपने स्तर से क्या कार्रवाई करते हैं.
