सुप्रीम कोर्ट का बड़ा फैसला, बेटी को अपने पिता की संपत्ति में बराबरी का अधिकार

नयी दिल्ली – सुप्रीम कोर्ट ने मंगलवार को बड़ा फैसला सुनाते हुए कहा है कि एक बेटी को अपने पिता की संपत्ति में बराबरी का अधिकार है। अदालत ने कहा कि संशोधित हिंदू उत्तराधिकार अधिनियम के तहत यह बेटियों का अधिकार है और बेटी हमेशा बेटी रहती है। कोर्ट ने कहा कि हिंदू महिला को अपने पिता की संपत्ति में भाई के समान ही हिस्सा मिलेगा।
कोर्ट ने कहा कि नौ सितंबर 2005 के बाद से बेटियों के हिंदू अविभाजित परिवार की संपत्तियों में हिस्सा मिलेगा। बता दें कि साल 2005 में कानून बना था कि बेटा और बेटी दोनों के पिता की संपत्ति पर बराबर का अधिकार होगा। लेकिन, इसमें यह स्पष्ट नहीं था कि अगर पिता की मृत्यु 2005 से पहले हुई हो तो क्या ये कानून ऐसे परिवार पर लागू होगा या नहीं।
इस मामले में मंगलवार को न्यायाधीश अरुण मिश्रा की अगुवाई वाली पीठ ने फैसला सुनाया कि यह कानून हर परिस्थिति में लागू होगा। पीठ ने अपने फैसले में कहा कि यह कानून बनने से पहले अर्थात साल 2005 से पहले भी अगर पिता की मृत्यु हो गई है तो भी पिता की संपत्ति पर बेटी को बेटे के बराबर का अधिकार मिलेगा।
बता दें कि हिंदू उत्तराधिकार अधिनियम 1965 में साल 2005 में संशोधन किया गया था। इसके तहत पैतृक संपत्ति में बेटियों को बराबरी का हिस्सा देने का प्रावधान है। इसके अनुसार कानूनी वारिस होने के चाने पिता की संपत्ति पर बेटी का भी उतना ही अधिकार है जितना कि बेटे का। विवाह से इसका कोई लेना-देना नहीं है।
