नई दिल्ली: भारत के किसी भी नागरिक को बिना आधार या सबूत के ‘घुसपैठिया या अवैध प्रवासी’ कहना एक गंभीर मामला है. यह झूठ बोलने और अदालत को गुमराह करने के समान है और देश के दूसरे सर्वोच्च कानून कार्यालय का पद संभालने वाले किसी व्यक्ति को इस तरह की टिप्पणी करना शोभा नहीं देता. मणिपुर के कुकी-हमार-ज़ोमी समुदाय की महिलाओं के एक संगठन ने मंगलवार को सॉलिसिटर जनरल तुषार मेहता द्वारा सुप्रीम कोर्ट में की गई उस टिप्पणी को वापस लेने की मांग की है. संगठन ने अपने बयान में कहा है कि देश के सॉलिसिटर जनरल की ऐसी फ़िज़ूल और निराधार टिप्पणी अशोभनीय, अस्वीकार्य और घृणित है. यह मृतकों के परिवारों के लिए बहुत दुखद है, जो आज तक अपने प्रियजनों का अंतिम संस्कार करने में असमर्थ रहे हैं. बता दें कि पिछले 1 अगस्त को केंद्र और मणिपुर सरकार दोनों की ओर से पेश हुए मेहता ने सुप्रीम कोर्ट को बताया कि राज्य में ‘ज्यादातर लावारिस शव घुसपैठियों के हैं.’ उनकी टिप्पणी मणिपुर में हिंसा पर मुख्य न्यायाधीश डीवाई चंद्रचूड़ की अध्यक्षता वाली पीठ के समक्ष आधे दिन तक चली सुनवाई के अंत में आई.
अज्ञात होने से सड़ रहे हैं मुर्दाघर में 118 आदिवासी शव
सुनवाई में सीजेआई डीवाई चंद्रचूड़ ने कहा था कि आखिरकार, जिन लोगों के साथ बलात्कार किया गया और हत्या की गई, वे हमारे लोग थे, सही है? इसलिए, हमें यह सुनिश्चित करना होगा कि न्याय हो.’ मेहता ने इस बिंदु पर हस्तक्षेप करते हुए कहा था कि ‘ज्यादातर लावारिस शव उन घुसपैठियों के हैं, जो एक विशेष योजना के साथ आए और मारे गए. मैं और कुछ भी उल्लेख नहीं करना चाहता और बात को और बिगाड़ना नहीं चाहता. हालांकि, आदिवासी समुदायों की ओर से पेश वरिष्ठ अधिवक्ता कॉलिन गोंज़ाल्विस ने कहा था कि इंफाल में 118 आदिवासी शव मुर्दाघर में रखे हैं. शव महीनों से अज्ञात हैं, सड़ रहे हैं. हम उनकी पहचान करने के लिए वहां नहीं जा सकते. हमें शिनाख्त में मदद करने के लिए कोई प्रयास नहीं किया जा रहा है.
परिवार मौजूदा सुरक्षा स्थिति के कारण शवों तक पहुंचने में हैं असमर्थ
अब महिलाओं के फोरम ने यह भी दावा किया है कि इंफाल में कुछ मामलों में ऐसा हुआ है कि जहां-जहां शव रखे गए हैं, वहां शोक संतप्त परिवार मौजूदा सुरक्षा स्थिति के कारण शवों तक पहुंचने में असमर्थ हैं. ऐसे हालात में अगर वे शवों को लाने की कोशिश करेंगे तो उन्हें निश्चित मौत का सामना करना पड़ेगा. बयान में कहा गया है कि कुकी-हमार-ज़ोमी समुदाय इन शवों को चूड़ाचांदपुर में लाने के लिए बार-बार मांग कर रहा है, लेकिन इसका कोई असर नहीं हुआ है. फोरम ने कहा कि इसलिए महिलाएं चाहती हैं कि सॉलिसिटर जनरल अपनी टिप्पणी वापस लें. अब देखना है कि आखिर कबतक परिजनों को अपने खोए हुए मृतकों की शिनाख्त करने का मौका मिलता है…?
