झारखंड जनाधिकार महासभा ने PESA को लेकर JPRA में प्रस्तावित संशोधनों और नियमावली में सुधार के संलग्न ड्राफ्ट को जारी किया

रांची :  झारखंड जनाधिकार महासभा ने अबुआ राज की भावना के साथ पंचायत उपबंध (अनुसूचित क्षेत्रों पर विस्तार) पर बल दिया है. राज्य सरकार से अधिनियम, 1996 (PESA) को पूर्ण रूप से लागू करने की मांग की गई है. इसके लिए झारखंड पंचायत राज अधिनियम, 2001 (JPRA) में संशोधन के साथ PESA राज्य नियमवाली के ड्राफ्ट में सुधार की भी ज़रूरत बतायी गई है. महासभा ने सोमवार को एक प्रेस वार्ता में JPRA में प्रस्तावित संशोधनों और नियमावली में सुधार के संलग्न ड्राफ्ट को जारी किया.

महासभा के प्रवक्ताओं ने कहा कि झारखंड में दशकों से आदिवासियों की सांस्कृतिक पहचान, सामुदायिक स्वायत्तता और संसाधनों पर लगातार हमले होते रहे हैं. जबकि इन्हें रोकने के लिए संविधान के कई प्रावधान हैं एवं कई स्थानीय कानून भी हैं. ऐसी परिस्थिति में इनके विरुद्ध सामूहिक संघर्ष में PESA भी कुछ हद तक मदद कर सकता है.

JPRA में PESA के अधिकांश प्रावधान सम्मिलित नहीं 

PESA के अनुसार अनुसूचित क्षेत्र में त्रि-स्तरीय पंचायत व्यवस्था के प्रावधानों का विस्तार होगा. लेकिन, आदिवासी सामुदायिकता, स्वायत्तता और पारम्परिक स्वशासन इस पंचायत व्यवस्था का मुख्य केंद्र बिंदु होगा एवं ग्राम सभा स्वायत्त और स्वशासी होगा. PESA के प्रावधान राज्य के पंचायत राज कानून से ही लागू हो सकते हैं, लेकिन JPRA में PESA के अधिकांश प्रावधान सम्मिलित नहीं है.

PESA के अनुसार, राज्य के पंचायत अधिनियम को अनुसूचित क्षेत्र के लिए रूढ़ि विधि, सामाजिक-धार्मिक परम्पराएं और सामुदायिक संसाधनों के पारम्परिक प्रबंधन व्यवस्था अनुरूप बननी है. लेकिन JPRA में यह मूल भावना सम्मिलित नहीं है. इसलिए सबसे पहले JPRA को संशोधित करने की ज़रूरत है.

वार्ता में कहा गया कि PESA के तहत ग्राम सभा के कुछ प्रमुख अधिकार जो JPRA में सम्मिलित नहीं हैं निम्न हैं – 1) भूमि अर्जन से पहले और पुनर्वास के पहले ग्राम सभा से सहमति, 2) गौण खनिजों पर नियंत्रण, 3) गौण वन उपजों पर मालिकाना, 4) गैर कानूनी तरीके से ली हुई जमीन वापसी करवाने की शक्ति, 5) सामुदायिक संसाधनों का पारंपरिक प्रबंधन व्यवस्था आदि.

इसके अलावा JPRA में अनुसूचित क्षेत्र के लिए ऐसे कई धाराएं व प्रावधान हैं जो PESA की मूल भावना के अनुरूप नहीं हैं. उदाहरण के लिए, ग्राम सभा के लिए कुल सदस्यों के महज़ 1/3 की उपस्थिति का कोरम रखा गया है. इससे सामूहिकता कमज़ोर होती है. पंचायत सचिव को ही ग्राम सभा का सचिव बनाया गया है. जबकि, अनुसूचित क्षेत्र में प्रशासन व बाहरी तत्वों द्वारा ग्राम सभाओं को नियंत्रित करने की कोशिश लगातार रहती है.

साथ ही, JPRA में ग्राम पंचायतों, पंचायत समिति व ज़िला परिषद् को कई अधिकार हैं जो PESA के तहत ग्राम सभा के अधिकार क्षेत्र पर हस्तक्षेप करते हैं. महासभा द्वारा JPRA में प्रस्तावित संशोधनों में PESA के सभी अधिकारों को जोड़ा गया है और उक्त कमियों को सुधारा गया है. साथ ही, राज्य के सभी सम्बंधित कानूनों में नियमावली के अनुसार संशोधन हो.

JPRA में PESA के सभी प्रावधानों को जोड़े बिना नियमावली बनाना उचित नहीं 

महासभा मानती है कि बिना मूल कानून (JPRA) में PESA के सभी प्रावधानों को जोड़े नियमावली बनाना उचित नहीं है, क्योंकि प्रावधानों को कानून का बल नहीं मिलेगा. पंचायत राज विभाग द्वारा बनाए गए नियमावली में अनेक गंभीर खामियां हैं. PESA का प्रमुख प्रावधान है कि परम्पराओं और रुढ़ि के अनुसार समाज समाविष्ट टोला/टोलों के समूह से एक गांव का गठन करना. लेकिन नियमावाली में ग्राम गठन के बदले ग्राम सभा गठन का वर्णन है.

PESA के अनुसार ग्राम सभा आदिवासी भूमि का गलत तरीके के हस्तांतरण को रोकने और ऐसी भूमि वापस करवाने के लिए सक्षम है. लेकिन नियमावली में निर्णायक भूमिका उपायुक्त को दिया गया है. वर्तमान नियमावली में सांस्कृतिक पहचान और सामुदायिक स्वायत्तता पर हो रहे हमलों को रोकने के लिए प्रक्रियाओं को नहीं जोड़ा गया है. महासभा द्वारा नियमावली में ऐसे कमियों को सुधारा गया है.

गठबंधन दलों ने PESA को पूर्ण रूप से लागू करने का चुनावी वादा किया था

महासभा विभिन्न संगठनों के लगातार संघर्ष से राज्य में PESA पर व्यापक चर्चा शुरू हुई है. लेकिन विभिन्न समूहों में PESA लागू करने की प्रक्रिया पर अलग-अलग सोच होने के कारण सरकार पर इसे लागू करने के सामूहिक दबाव नहीं पड़ रहा है. ऐसी एक गलत अवधारणा भी फ़ैल रही है कि PESA लागू होने से पंचायत ख़तम हो जायेंगे एवं PESA सीधा, बिना राज्य पंचायत कानून के लागू हो सकते हैं.

गठबंधन दलों ने PESA को पूर्ण रूप से लागू करने का चुनावी वादा किया था. विधान सभा सत्र में झामुमो विधायक हेमलाल मुर्मू समेत कई विधायकों ने भी इन मुद्दों को उठाया है. लेकिन अभी तक राज्य सरकार ने इस पर स्पष्ट प्रतिबद्धता नहीं दर्शाई है।

महासभा राज्य सरकार से मांग करती है कि तुरंत JPRA में संशोधन कर PESA के सभी प्रावधान जोड़े जायें एवं उसके अनुसार नियमावली बनाई जाये. साथ ही, प्रशासन और पुलिस को ग्राम सभा के अधिकारों के विषय में जागरूक किया जाये एवं यह सुनिश्चित किया जाये कि वे ग्राम सभा के अधिकारों का उल्लंघन न करें.
