हजारीबाग में आदिवासी भूमि की संदिग्ध खरीद-बिक्री पर उठे सवाल, अस्पताल निर्माण के नाम पर हुआ सौदा

हजारीबाग, 20 मई 2025 | हजारीबाग जिले के सरले मोजा क्षेत्र में आदिवासी रकबे की एक जमीन को लेकर विवाद गहराता जा रहा है। आरोप है कि थाना संख्या 159, खाता संख्या 93, और प्लॉट संख्या 162 की 2.33 डिसमिल भूमि, जो आदिवासी वर्ग के अंतर्गत आती है, उसे अस्पताल निर्माण के बहाने कम कीमत पर खरीदा गया और बाद में उसे गैर-आदिवासी व्यक्तियों को ऊँचे दामों में बेचा जा रहा है।

स्थानीय सूत्रों के अनुसार, एल्बिनुस खाखा और लारेंस तिर्की नामक दो व्यक्तियों ने कथित रूप से इस आदिवासी जमीन को अधिग्रहित किया। बताया गया कि दोनों ने जमीन मालिकों को अस्पताल जैसी सामाजिक सुविधा के निर्माण का हवाला देकर विश्वास में लिया और बेहद कम दर पर सौदा कर लिया। इसके पश्चात उसी जमीन को बाजार दर से कहीं अधिक कीमत पर ‘जनरल’ वर्ग के लोगों को हस्तांतरित किया जा रहा है।

“यह जमीन केवल आदिवासियों की है” — स्थानीय विरोध

स्थानीय आदिवासी समुदाय का कहना है कि उक्त जमीन मूलतः अनुसूचित जनजाति (ST) की श्रेणी में दर्ज है और इस पर किसी भी गैर-आदिवासी का स्वामित्व कानूनन अवैध माना जाता है। उनका आरोप है कि इस लेन-देन की प्रक्रिया ने न केवल आदिवासी अधिकारों का हनन किया है, बल्कि झारखंड भूमि सुधार अधिनियम के प्रावधानों की भी अवहेलना की गई है।

कई सामाजिक संगठनों और ग्रामवासियों ने प्रशासन से इस सौदे की जांच कराने और दोषियों पर कार्रवाई की मांग की है। उनका तर्क है कि आदिवासी भूमि की रक्षा के लिए बनाए गए कानूनों को दरकिनार कर इस प्रकार की खरीद-बिक्री से न केवल आदिवासियों का विस्थापन हो रहा है, बल्कि सामाजिक असंतुलन भी उत्पन्न हो रहा है।

प्रशासन से कार्रवाई की मांग

इस मामले पर अब तक कोई आधिकारिक प्रतिक्रिया सामने नहीं आई है, लेकिन जमीन के दस्तावेजों की सत्यता और सौदे की वैधता को लेकर जांच की मांग तेज हो गई है। आदिवासी संगठनों का कहना है कि यदि ऐसे मामलों पर जल्द कार्रवाई नहीं की गई तो वे आंदोलन की राह पकड़ेंगे।

पृष्ठभूमि और कानूनी स्थिति

झारखंड में CNT (छोटानागपुर काश्तकारी अधिनियम) और SPT (संथाल परगना अधिनियम) जैसे कानून आदिवासी जमीन की सुरक्षा के लिए बनाए गए हैं, जिनके तहत आदिवासी भूमि को गैर-आदिवासी को बेचना प्रतिबंधित है, जब तक कि जिलाधिकारी से पूर्व अनुमति न ली जाए।

इस विवाद ने एक बार फिर राज्य में आदिवासी भूमि संरक्षण की आवश्यकता और प्रशासन की भूमिका पर सवाल खड़े कर दिए हैं।
