गोमिया—तेनुघाट व्यवहार न्यायालय के जिला एवं सत्र न्यायाधीश प्रथम फहीम किरमानी की अदालत ने हत्या के एक मामले में पेटरवार थाना क्षेत्र के ओरदाना निवासी देवशरण महतो को दोषी करार देते हुए आजीवन कारावास एवं 25 हजार रुपये जुर्माने की सजा सुनाई है। सजा सुनाए जाने के बाद दोषी को न्यायिक अभिरक्षा में तेनुघाट मंडल कारा भेज दिया गया।
अभियोजन के अनुसार, पेटरवार थाना क्षेत्र के ओरदाना निवासी नीरज कुमार महतो ने 5 जून 2023 को दर्ज कराए गए फर्दबयान में बताया था कि घटना की रात उनके पिता उपेंद्र महतो घर की छत पर सोए हुए थे। रात करीब 12 बजे तेज आवाज सुनकर जब वह जागे तो देखा कि गांव के ही देवशरण महतो धारदार हथियार से उनके पिता पर हमला कर रहा है। पकड़ने का प्रयास करने पर आरोपी मौके से फरार हो गया। हमले में उपेंद्र महतो के बाएं कनपटी पर गंभीर चोट लगी थी, जिससे उनकी घटनास्थल पर ही मौत हो गई। सूचक ने यह भी बताया था कि आरोपी पूर्व से उनके पिता को जान से मारने की धमकी देता था।
फर्दबयान के आधार पर पेटरवार थाना कांड संख्या 79/2023 दर्ज कर पुलिस ने अनुसंधान पूरा करते हुए न्यायालय में आरोप पत्र समर्पित किया। इसके बाद मामला सत्रवाद संख्या 422/2023 के रूप में जिला एवं सत्र न्यायाधीश प्रथम की अदालत में विचारण के लिए चला।
मामले की सुनवाई के दौरान प्रस्तुत साक्ष्यों, गवाहों के बयान एवं दोनों पक्षों की दलीलों पर विचार करने के बाद न्यायालय ने देवशरण महतो को हत्या का दोषी पाते हुए आजीवन कारावास एवं 25 हजार रुपये जुर्माने की सजा सुनाई।
मामले में अभियोजन पक्ष की ओर से अपर लोक अभियोजक सर्वेश आनंद सिंह ने पैरवी की, जबकि सूचक की ओर से अधिवक्ता चेतनानंद प्रसाद ने न्यायालय में अपना पक्ष रखा।
