भुईंहरी जमीन हड़पने के लिए पंचवटी बिल्डर्स ने तीन मृतत्माओं के फर्जी हस्ताक्षर करा लिए

राजधानी रांची में बिल्डरों ने सरकारी सिस्टम को अपनी कठपुतली बना रखा है. इनके लिए कोई नियम-कानून नहीं है। अफसरों के सहयोग से बिल्डर जमीन के मूल नक्शे में छेड़छाड़ कर, फर्जी दस्तावेज के सहारे और फर्जी हस्ताक्षर कर कहीं भी अपार्टमेंट बना लेने में कामयाब हो जाते हैं। बहुचर्चित पल्स अस्पताल  की भुईंहरी जमीन हथियाने के लिए पंचवटी बिल्डर्स ने मृतत्माओं के फर्जी हस्ताक्षर तक करा लिए. रांची नगर निगम के अधिकारियों ने बगैर इसकी जांच किए नक्शा पास भी कर दिया.    

तीन मृत भुईंहरदार के फर्जी हस्ताक्षर से रसीद कटी

अब इस चित्र को गौर से देखिए… ये भुईहरदार जमींदार की ओर से जारी की जानेवाली मालगुजारी रसीद है. तीन भुईंहरी जमींदार के (लाल घेरे में) फर्जी हस्ताक्षर हैं. किसी जमाने में ये जमींदार अपने स्तर से रैयतों के लिए रसीद काट कर देता था. ये तीनों भुईंहरदार ढाई दशक पूर्व स्वर्गवासी हो चुके हैं. लेकिन तीनों ने पंचवटी बिल्डर्स को एक ही दिन यानी 22.10.2016 को मालगुजारी की रसीद काट कर दी है. इनमें जमींदार सुकरा मुंडा,  खाता सं-162, जगतू मुंडा, खाता सं-161 और बिरसा मुंडा, खाता सं-160 है. रसीद में पहले जमींदार का नाम फिर आसामी का नाम पंचवटी बिल्डर्स और जमीन का विवरण लिखा हुआ है.

कृष्णा मुंडा ने कहा-सभी हस्ताक्षर फर्जी

इस रसीद की सच्चाई की पुष्टि के लिए भुईहरदारों के वंशज कृष्णा मुंडा ने देखा तो वह अवाक रह गया. उसने बताया कि यह पूरी तरह से फर्जी रसीद है. उसका कहना है कि उनके दादा सुकरा मुंडा हस्ताक्षर करना जानते ही नहीं थे. वह बिल्कुल अपढ़ थे. उनकी मृत्यु 1995 में हो गई है. इसके अलावा उनके रिश्तेदार जगतू मुंडा और बिरसा मुंडा के देहांत हुए करीब 25 वर्ष से अधिक हो गए. ये दोनों किसी तरह से अपना हस्ताक्षर कर लेते थे. लेकिन मालगुजारी की रसीद में जो हस्ताक्षर हैं, वो उनके रिश्तेदार के नहीं हैं.

तीसरी बार रवि सरावगी के नाम से सेल डीड बना       

कागजात की छानबीन से पता चलता है कि नगर निगम के अधिकारी बगैर आवश्यक जांच-पड़ताल के भुईंहरी जमीन पर बहुमंजिला अस्पताल बनाने का परमिशन दे दिया. मजेदार बात तो ये है कि एक नहीं, तीन बार (2015, 2017 और 2018) भईंहरी जमीन को सरकार के नाम गिफ्ट दिखा दिया गया है. यहां हम विशेष रूप से 2018 में रवि कुमार सरावगी, पिता गोविंद राम सरावगी के नाम से बने सेल डीड का जिक्र कर रहे हैं. रवि सरावगी के बड़े भाई आलोक सरावगी ने यही काम 2015-17 में भी किया. पंचवटी बिल्डर्स की यूनिट के मेसर्स पंचवटी प्रमोटर्स प्रा.लि. के निदेशक रवि कुमार सरावगी के नाम से सेल डीड बना और नगर निगम से नक्शा पास करा लिया गया. कागजात के अनुसार पल्स संजीवनी हेल्थ केयर प्रा.लि. के निदेशक अभिषेक झा, पिता- कामेश्वर झा ने 3 करोड़ 60 लाख में जमीन खरीद ली.

रुंगटा फैमिली के नाम से भी बना गिफ्ट डीड

इससे पूर्व जो गिफ्ट डीड बने हैं उनमें आरसीआरजीएनएसएस लिमिटेड के तत्कालीन अध्यक्ष पुष्पा रुंगटा और सचिव सुनील रुंगटा के नाम हैं. इसके पावर होल्डर आलोक कुमार सरावगी थे. रांची नगर निगम के पूर्व सीईओ के प्रतिनिधि के रूप में नागेंद्र दुबे को 22 सितंबर 2015 को गिफ्ट किया. इस तरह निगम के अफसरों ने इस पुण्य काम को पूर्व में दो बार किया. इसके बाद 2018 में रवि कुमार सरावगी ने भी खाता सं-160, 161 और 162 के प्लॉट नं-1248, 1249, 1250 और 1251 के कुल रकबा 36.49 डिसमिल जमीन भुईंहरदार जुना मुंडा वल्द बुकना मुंडा से रजिस्ट्री करा ली गई. दरअसल, जमीन को सीएनटी सीएनटी एक्ट 1908 के संशोधन के सेक्शन 49 (1938 अनुसूची) के तहत 13 मार्च 1946 को रांची के उपायुक्त से रजिस्ट्री करा ली गई.

1869 के भुईंहरी कानून में कभी कोई संशोधन नहीं हुआ: रश्मि कात्यायन

झारखंड के काश्तकारी कानूनों के जानकार और विशेष करआदिवासी समुदाय की पारंपरिक मिल्कियत भुईंहरी एवं मुंडारी खुंटकट्टी जमीनों के इतिहास की विश्वसनीय जानकारी रखनेवाले रांची के वरिष्ठ अधिवक्ता रश्मि कात्यायननेसवाल उठाया कि जब अंग्रेजों के समय के 1869 के भुईंहरी कानून में आज तक कोई संशोधन नहीं हुआ तो, फिर इसे सीएनटी में कैसे और किसने शामिल करा दिया. इसका जवाब तो सरकार के पास होना चाहिए. श्री कात्यायन का कहना है कि मान लें किसी भुईंहरी जमीन पर स्कूल बनाने की स्वीकृति उपायुक्त के द्वारा ली गई है, अगर स्कूल बंद हो जाता है, तो जिस व्यक्ति को स्वीकृति मिली है, वह उस जमीन को दूसरे कामों में उपयोग में नहीं ला सकता, न ही वह व्यक्ति भुईंहरी जमीन बेच सकता है. स्कूल बंद होने की स्थिति में मूल भूस्वामी को यह जमीन स्वत: वापस हो जानी चाहिए. भुईंहरी जमीन की खरीद-बिक्री आदिवासियों के बीच भी नहीं हो सकती है. अगर किसी सार्वजनिक कार्य के लिए किसी को जमीन दी जाती है तो इसके लिए उपायुक्त की स्वीकृति अनिवार्य है. इसके बावजूद उपायुक्त के परमिशन से जमीन का जो पट्टा तैयार किया जाता है, उसमें जमीन के उपयोग का टर्म कंडीशन स्पष्ट रूप से लिखा जाना अनिवार्य है. भुईंहरी जमीन का उपयोग दूसरे कार्यों में नहीं किया जा सकता है. सार्वजनिक कार्य बंद होने की स्थिति में वो जमीन स्वत: जमीन मालिक को वापस हो जाती है.

5-6 खरीदारों के बाद पंचवटी बिल्डर्स के हाथ लगी जमीन

दरअसल, बरियातू रोड पर मौजा मोरहाबादी के खाता संख्या 162 के प्लॉट संख्या 1248 और खाता संख्या 160 के प्लॉट नंबर 1249 व 1251 पर 13 मंजिला हॉस्पिटल बना है। इस जमीन की प्रकृति बकास्त भुईहरी है, जिसकी खरीद-बिक्री नहीं हो सकती। लेकिन वर्ष 1945-46 में इस जमीन की खरीद-बिक्री रांची डीसी के आदेश से हुई थी। फिर छह-सात खरीदारों से होते हुए पंचवटी बिल्डर्स ने ली। पंचवटी बिल्डर्स के निदेशक रवि सरावगी ने नगर निगम से पल्स हॉस्पिटल का नक्शा पास कराया है। खबर है कि जांच कमेटी ने रिपोर्ट में इसका जिक्र नहीं किया कि आखिर जमीन में कहां हेरफेर हुई है। अब देखना है कि ईडी कबतक जांच रिपोर्ट का खुलासा करता है, इसपर भुईंहर परिवार की निगाहें टिकी हुई हैं.
