खनिज की रॉयल्टी के मामले में SC का ऐतिहासिक फैसला: CM ने इसे बड़ी जीत बताते हुुए कहा- राज्यवासियों के लिए बड़ी खुशखबरी है…क्योंकि अब राज्य को केंद्र से बकाये के 1.26 लाख करोड़ रुपये मिलेंगे

रांची :  झारखंड को वर्ष 2005 से खनिज की रॉयल्टी का बकाया मिलेगा। चरणबद्ध तरीक़े से 12 साल में यह भुगतान होगा। अब झारखंड को केंद्र से बकाये के 1 लाख 36 हज़ार करोड़ रुपये मिलेंगे। राज्यों के खदानों और खनिज युक्त भूमि पर कर लगाने के अधिकार को बरकरार रखने को लेकर बुधवार को सुप्रीम कोर्ट के इस ऐतिहासिक फैसले के बाद मुख्यमंत्री हेमंत सोरेन इसे बड़ी जीत बताया है. सीएम ने कहा है कि सुप्रीम कोर्ट के ऐतिहासिक फ़ैसले से हर झारखंडी के इस बकाये और अधिकार को लेकर आपकी अन्य सरकार लगातार आवाज़ बुलंद कर रही थी। राज्यवासियों के हक़ सुरक्षित होने के साथ इन पैसों का उपयोग अब जन-कल्याण में किया जाएगा.

राज्यों को एक अप्रैल 2005 के बाद से रॉयल्टी वसूल करने की अनुमति मिल गई

बता दें कि सुप्रीम कोर्ट ने पिछले 25 जुलाई के अपने फैसले को प्रभावी ढंग से लागू करने की केंद्र की याचिका आज खारिज कर दी, जिसमें राज्यों के पास खदानों और खनिज युक्त भूमि पर कर लगाने के विधायी अधिकार को बरकरार रखा गया था। इसके साथ ही कोर्ट ने राज्यों को एक अप्रैल 2005 के बाद से रॉयल्टी वसूल करने की अनुमति दे दी। सीजेआई डीवाई चंद्रचूड़ की अध्यक्षता वाली नौ सदस्यीय संविधान पीठ ने कहा कि 25 जुलाई के आदेश को प्रभावी रूप से लागू करने की दलील खारिज की जाती है।

कोर्ट ने राज्यों को बकाये के भुगतान पर किसी प्रकार का जुर्माना नहीं लगाने का भी निर्देश दिया

पीठ ने कहा कि हालांकि, पिछले बकाये के भुगतान पर कुछ शर्तें होंगी। कहा कि केंद्र तथा खनन कंपनियां खनिज संपन्न राज्यों को बकाये का भुगतान अगले 12 वर्ष में क्रमबद्ध तरीके से कर सकती हैं। पीठ ने राज्यों को बकाये के भुगतान पर किसी प्रकार का जुर्माना न लगाने का निर्देश भी दिया। केंद्र ने खनिज संपन्न राज्यों को 1989 से खनिजों और खनिज युक्त भूमि पर लगाई गई रॉयल्टी उन्हें वापस करने की मांग का विरोध करते हुए कहा था कि इसका असर नागरिकों पर पड़ेगा और शुरुआती अनुमान के अनुसार सार्वजनिक क्षेत्र की कंपनियों (पीएसयू) को अपने खजाने से 70,000 करोड़ रुपये निकालने पड़ेंगे। बहरहाल, खनिज से भरपूर झारखंड को इस फैसले से भविष्य में काफी फायदा हो सकेगा.
