कहां जाकर रुकेगा केंद्र और सुप्रीम कोर्ट का टकराव…? सबसे बड़ी अदालत को देश सर्वोच्च मानता है,पर केंद्र को लगने लगे हैं आपत्तिजनक

नई दिल्ली : देश के सर्वोच्च न्यायालय और केंद्र के बीच का टकराव भी अब सनातन हो चला है. ये टकराव कांग्रेस की सरकारों के समय भी था और आज भाजपा की लंगड़ी सरकार के समय में भी है, बल्कि आज ये टकराव कुछ ज्यादा ही तेज हो गया है. राष्ट्रपति और राज्यपालों द्वारा विधानसभा से पारित विधेयकों पर मंजूरी या रोक लगाने को लेकर सुप्रीम कोर्ट के आदेश पर केंद्र की तीखी प्रतिक्रिया से इस टकराव की आवाजें साफ सुनी जा सकती हैं.

बता दें कि केंद्र ने कहा कि शीर्ष अदालत का यह फैसला संविधान द्वारा प्रदत्त शक्तियों के दायरे में अनुचित दखल है, जो विधायिका, कार्यपालिका और न्यायपालिका के बीच शक्ति संतुलन को अस्थिर कर सकता है। केंद्र ने अपनी लिखित दलीलों में कहा, “विस्तृत न्यायिक पुनरीक्षण की प्रक्रिया संवैधानिक संतुलन को अस्थिर कर देगी और तीनों अंगों के बीच संस्थागत पदानुक्रम पैदा कर देगी। न्यायपालिका हर संवैधानिक पेचीदगी का समाधान नहीं दे सकती।”

8 अप्रैल को जस्टिस जेबी पारदीवाला और आर महादेवन की पीठ ने राष्ट्रपति और राज्यपालों के लिए विधेयकों पर निर्णय की समय सीमा तय की थी तथा तमिलनाडु के 10 विधेयकों को ‘डिम्ड असेंट’ घोषित कर दिया था। केंद्र ने कहा कि अनुच्छेद 142 अदालत को ऐसा करने की अनुमति नहीं देता और यह संवैधानिक प्रक्रिया को उलटने जैसा है।

केंद्र का मानना है कि राष्ट्रपति और राज्यपालों के निर्णयों पर न्यायिक शक्तियों का उपयोग करना न्यायपालिका को सर्वोच्च बना देगा, जबकि संविधान की मूल संरचना में ऐसा नहीं है। तीनों अंग (विधायिका, कार्यपालिका और न्यायपालिका) एक ही संवैधानिक स्रोत से शक्ति प्राप्त करते हैं और किसी को भी दूसरों पर श्रेष्ठता प्राप्त नहीं है।

सुप्रीम कोर्ट द्वारा तय की गई समय सीमा असंवैधानिक कैसे?

केंद्र का मानना है कि विधेयकों से जुड़े सवालों के समाधान राजनीतिक प्रक्रिया और लोकतांत्रिक उपायों से होने चाहिए, न कि न्यायिक आदेशों से। उसने कहा कि संविधान ने जहां आवश्यक समझा, वहां समय सीमा का उल्लेख किया है, पर अनुच्छेद 200 और 201 में कोई समय सीमा नहीं दी गई है। ऐसे में न्यायालय द्वारा तय की गई समय सीमा असंवैधानिक है।

मजे की बात ये है कि जिस सबसे बड़ी अदालत को पूरा देश सर्वोच्च मानता है उसके फैसले ही अब केंद्र को आपत्तिजनक लगने लगे हैं. केंद्र ने कहा कि राज्यपाल न तो राज्यों में बाहरी व्यक्ति हैं और न ही केवल केंद्र के दूत। वे राष्ट्रीय हित और लोकतांत्रिक भावना का प्रतिनिधित्व करते हैं।

केंद्र की ये तकरार कम, ज्यादा होती आई है. श्रीमती इंदिरा गांधी हों या राजीव गांधी सभी ने सर्वोच्च न्यायालय की सर्वोच्चता को न सिर्फ चुनौती दी, बल्कि धता भी बताया.

मोदी सरकार चाहती है सुप्रीम कोर्ट उसके इशारों पर काम करे

मौजूदा मोदी सरकार इंदिरा गांधी और राजीव गांधी से भी चार कदम आगे बढ गए हैं. मोदी सरकार चाहती है कि सुप्रीम कोर्ट भी उसके इशारों पर वैसे ही काम करे जैसे ईडी, सीबीआई और सीईसी कर रहे हैं. राम मंदिर मस्जिद विवाद में  तबके सुप्रीम न्यायाधीशों ने ये किया भी. बदले में राज्यसभा की सीट भी हासिल की.

उल्लेखनीय है कि सुप्रीम कोर्ट ने वक्फ बोर्ड कानून पर अपना फैसला अभी नहीं सुनाया है. इस बीच बिहार के बहुचर्चित वोट चोरी कांड यानी एसआईआर की बखिया भी उधेड़ दी है, इससे भी मोदी सरकार सुप्रीम कोर्ट को लेकर न सिर्फ असहज है, वरन आक्रामक भी है.

केंद्र ने इससे पहले तत्कालीन उपराष्ट्रपति जगदीप धनकड़ और राष्ट्रपति श्रीमती द्रोपदी मुर्मू के जरिए भी सुप्रीम कोर्ट को हडकाने का दुस्साहस किया था, किंतु सुप्रीम कोर्ट दबाब में नहीं आया.

वर्तमान मुख्य न्यायाधीश जस्टिस बीआर गवई न पूर्व के सीजेआई की तरह मोदीजी को अपने घर किसी पूजा में बुला रहे हैं और न ही उन्होंने अपनी सेवा निवृति के बाद कोई सरकारी, असरकारी पद की अपेक्षा की है. देखना होगा कि अब सुप्रीम कोर्ट और केंद्र के बीच का टकराव कौन सी करवट लेता है?
