हे सिद्धभूमि हम शर्मिंदा हैं…! आखिर सर्वे नाले की जमीन किसने हड़पी..? दो जैन संस्थाएं निगल गईं नाला.. दो संस्थाएं, दो नोटिस, एक प्लॉट और एक नाला…!

गिरिडीह: जो नोटिस सात साल पहले अनुमंडल पदाधिकारी के दफ्तर से चला था, उस पर कार्रवाई क्या हुई, पता नहीं..! अब उससे ही मिलता जुलता पत्र अंचल अधिकारी के दफ्तर से निकला है…! कार्रवाई होगी..? अहम सवाल यही है..? कहानी मधुबन में स्थित गुणायतन और सम्मेदाचल विकास कमेटी के बीच बहने वाले उस नाले की है, जिससे बीसपंथी कोठी से लेकर तेरहपंथी और कच्छी भवन की गंदगी बहकर इलायची मति माता जी के आश्रम से होती हुई शाश्वत और प्रकाश भवन के पीछे से निकलकर पश्चिम को ओर बहती थी। इस संबंध में गुणायतन संस्था को डुमरी अनुमंडल पदाधिकारी ने 21 मई 2015 को नोटिस जारी किया था, और ठीक 7 साल 7 महीने बाद कुछ ऐसा ही नोटिस नाले के अतिक्रमण को लेकर पीरटांड़ अंचलाधिकारी ने श्री दिगंबर जैन सम्मेदाचल विकास कमेटी को भेजा है। मतलब पहले नोटिस पर कोई कार्रवाई नहीं हुई, अब दूसरे नोटिस पर खानापूर्ति करने की तैयारी है…!

पाए वो अंचल अधिकारी करेंगे..?

2015 के नोटिस को आसान भाषा में ऐसे समझिए?

21 मई 2015 का नोटिस सुभाष जैन, प्रबंधक, गुणायतन न्यास ट्रस्ट को दिया गया।

इस नोटिस में साफ लिखा है कि गुणायतन ने सरकारी बंदोबस्ती भूमि का अवैध तरीके से क्रय किया और अवैध तरीके से जमाबंदी कायम कराकर दखल कब्जा किया..।

नोटिस में कहा गया है कि मौजा मधुबन में थाना नंबर 97, खाता नंबर 36, प्लॉट नंबर 375, रकवा 1.18 एकड़ सर्वे नाला की जांच अंचल अधिकारी, पीरटांड़ से कराई गई।

जांचोपरांत अंचल अधिकारी द्वारा यह प्रतिवेदित किया गया कि उक्त सर्वे नाला का डायवर्सन गुणायतन ट्रस्ट की भूमि पर किया गया है।

प्लॉट नंबर 367,374,377 और 378 में करने हेतु उपायुक्त, गिरिडीह के निर्देश का भी जिक्र है जिसमें कहा गया है कि “गुणायतन ट्रस्ट की जमीन के मध्य बह रहे नाले का डायवर्सन गुणायतन की जमीन के प्लॉट संख्या 367,377 और 378 पर करने में गिरिडीह के उपायुक्त को कोई आपत्ति नहीं है।

सर्वे नाले को भरने का कोई भी निर्देश नहीं दिया

उक्त पत्र में सर्वे नाले को भरने के संबंध में कोई भी निर्देश नहीं दिया गया है, फिर भी गुणायतन द्वारा उक्त सर्वे नाले को भरकर गुणायतन की जमीन में मिला लिया और सर्वे नाले का डायवर्सन प्लॉट नंबर 377 की भूमि पर कर दिया गया।

अनुमंडल पदाधिकारी के पत्र में कहा गया है कि गुणायतन ट्रस्ट ने प्लॉट संख्या 377 रकवा 0.90 एकड़ भूमि मौजी तूरी, पिता- हेमलाल तुरी, साकिन– मधुबन को कृषि कार्य एवं परिवार के भरण-पोषण करने के लिए सरकार द्वारा बंदोबस्ती में दी गई थी।

कालांतर में गुणायतन ट्रस्ट द्वारा उक्त भूमि जिसका रकवा 0.85 एकड़ है, को अवैध तरीके से क्रय और जमाबंदी कायम कराकर दखल कब्जा कर लिया गया है, जो अवैध और गैरकानूनी है।

अब 21 दिसंबर 2022 के नोटिस को समझिए..!

1. यह नोटिस अंचल अधिकारी ने श्री दिगंबर जैन सम्मेदाचल विकास कमेटी को भेजा है।
2. नोटिस में कहा गया है कि कमेटी द्वारा खाता नंबर 36, प्लॉट नंबर 375, रकवा 1.18 एकड़ भूमि जो सर्वे खतियान में गैर मजरुवा खास जमीन नाला है।
3. संस्था द्वारा नाले की ढलान को काट कर नाले की भूमि पर कब्जा करने की बात कही गई है।

अब हमारे अहम सवाल पर जरा गौर फरमाएं

• जब 7 साल 7 महीने पहले अनुमंडल पदाधिकारी की ओर से जो नोटिस भेजा गया था उस पर क्या कार्रवाई हुई?
• जब प्लॉट संख्या 377 पर नाले को गुणायतन संस्था द्वारा डायवर्ट कर दिया गया तो फिर किस आधार पर श्री सम्मेदाचल विकास कमेटी को अंचल अधिकारी द्वारा नोटिस जारी किया गया ?
• 2015 के नोटिस में इस बात का जिक्र है के अंचल अधिकारी ने सर्वे नाला के डायवर्सन की रिपोर्ट अनुमंडल पदाधिकारी को भेजी थी, तो क्या मान लिया जाए क्या अंचल अधिकारी ने जो रिपोर्ट भेजी वह फर्जी थी?
• 2015 के नोटिस में , इस बात का भी जिक्र है कि गुनायतन संस्था ने सर्वे नाले को भरकर गुनायतन की जमीन में मिला लिया, तो फिर सम्मेदाचल विकास कमेटी को नोटिस भेजने का आधार क्या है ? इस बात का जवाब अंचल अधिकारी को देना चाहिए!
• अनुमंडल पदाधिकारी के नोटिस में इस बात का भी जिक्र है कि ३७७ नंबर प्लॉट मौजी तूरी के नाम से कृषि कार्य एवं परिवार के भरण पोषण करने हेतु सरकार द्वारा बंदोबस्ती में दिया गया है तो क्या मौजी तुरी को उक्त जमीन वापस की गई? अंचल कार्यालय को उस अंचलाधिकारी का नाम बताना चाहिए जिसने 2015 में सर्वे नाला का जांच प्रतिवेदन दिया था?

सवाल उठता है कि जब 377 नंबर प्लॉट पर नाले का डायवर्सन कर दिया गया, और 375 प्लॉट जिसपर सर्वे का नाला था, उसे अपनी जमीन पर मिला लिया गया (जैसा 2015 के नोटिस में लिखा गया है), तो 375 नंबर प्लॉट पर सम्मेदाचल विकास ने कैसे अतिक्रमण किया? ये सबसे बड़ा सवाल है.
