देश में बदलाव की एक नई लहर चल पड़ी है। हाल ही में न्याय की देवी के प्रतीकात्मक स्वरूप में बदलाव किया गया। पहले वह आँखों पर पट्टी, तराजू, और तलवार लिए दिखती थी। अब उसकी आँखों पर पट्टी नहीं है, तलवार की जगह संविधान ने ले ली है। यह परिवर्तन सकारात्मक है, लेकिन सवाल उठता है—क्या केवल प्रतीकात्मक बदलाव से न्याय व्यवस्था की दशा-दिशा बदल जाएगी?
लंबित मामलों का बोझ और न्याय की धीमी प्रक्रिया
देश की न्याय व्यवस्था पर सबसे बड़ा सवाल लंबित मामलों का है। 2024 में अदालतों में 5.1 करोड़ से अधिक केस लंबित थे, जिनमें 30 साल से भी अधिक समय से चले आ रहे 1,80,000 मामले शामिल हैं। नीति आयोग की रिपोर्ट के अनुसार, यदि यही गति रही, तो सभी लंबित मामलों के निपटारे में 324 साल लग सकते हैं।
अदालतों में लंबित केस केवल पीड़ितों और आरोपियों के लिए समस्या नहीं हैं, बल्कि यह पूरी न्याय व्यवस्था पर सवाल खड़े करते हैं। ऐसी स्थिति में, न्याय की देवी का बदला स्वरूप क्या इन समस्याओं को हल कर सकता है?
पुराने नियम और न्याय की राह में रुकावटें
देश में आज भी कई कानूनी प्रक्रियाएँ पुराने नियमों पर आधारित हैं। ये नियम समय के साथ अप्रासंगिक हो गए हैं और न्याय में देरी का कारण बनते हैं।
- सीआरपीसी का नियम: आरोपी या गवाह की अनुपस्थिति में सुनवाई को स्थगित करना, जिससे 60% से अधिक आपराधिक मामले लंबित हो जाते हैं।
- निर्दोष विचाराधीन कैदी: हजारों कैदी वर्षों से जेल में हैं, जिनका अपराध साबित नहीं हुआ। बिहार में एक व्यक्ति को 28 साल बाद निर्दोष घोषित किया गया, लेकिन तब तक उसके जीवन के महत्वपूर्ण साल बर्बाद हो चुके थे।
तकनीकी समाधान और सुधार की आवश्यकता
न्याय व्यवस्था में सुधार के लिए केवल प्रतीकों पर निर्भर रहना पर्याप्त नहीं है। इसके लिए जमीनी स्तर पर बड़े बदलाव करने होंगे:
- फास्ट-ट्रैक कोर्ट्स: मामलों के तेजी से निपटारे के लिए विशेष अदालतों का गठन।
- तकनीकी समाधान: ऑनलाइन सुनवाई और आर्टिफिशियल इंटेलिजेंस आधारित केस मैनेजमेंट सिस्टम।
- जजों की संख्या में वृद्धि: भारत में प्रति 10 लाख की आबादी पर केवल 21 जज हैं, जो न्यायालयों पर बढ़ते बोझ को कम करने में नाकाफी हैं।
- सुनवाई प्रक्रिया में पारदर्शिता: अदालतों की कार्यवाही को अधिक पारदर्शी बनाने की जरूरत है।
प्रतीकात्मक बदलाव से असली बदलाव तक का सफर
न्याय की देवी के स्वरूप में बदलाव हमें सोचने पर मजबूर करता है कि न्याय व्यवस्था में सुधार कैसे लाया जा सकता है। लेकिन असली बदलाव तभी होगा जब:
- फैसले समय पर और निष्पक्ष हों।
- लंबित मामलों को प्राथमिकता दी जाए।
- न्याय पाने की प्रक्रिया को सरल और सुलभ बनाया जाए।
न्याय का असली अर्थ
न्याय की देवी का नया स्वरूप सकारात्मक सोच का प्रतीक है, लेकिन असली बदलाव केवल प्रतीकों से संभव नहीं है। न्याय का अर्थ है समय पर निष्पक्ष फैसला देना। इसके लिए न्याय व्यवस्था में तकनीकी सुधार, पुराने नियमों में बदलाव और अदालती प्रक्रियाओं को तेज़ करना आवश्यक है।
यह वक्त है कि हम प्रतीकात्मक बदलावों से आगे बढ़ें और न्याय व्यवस्था को सशक्त बनाएं। तभी हम एक ऐसा समाज बना पाएंगे जहाँ हर व्यक्ति को यह भरोसा हो कि उसे समय पर न्याय मिलेगा। यही असली न्याय है, और यही असल बदलाव।
